The United States Attorney's Office for the Northern District of California announced today that David Kenneth Huffman was sentenced today to 46 months in prison for the possession and receipt of child pornography.  The sentence was handed down by U.S. District Court Judge William H. Alsup following a guilty plea on two counts in violation of 18 U.S.C. §§ 2252A(a)(2)(A) and (a)(5)(B).

Mr. Huffman, 29, of Fortuna, California, was indicted by a federal grand jury on January 8, 2003.  He was charged with possessing and receiving child pornography and with attempted production of child pornography.

According to the plea agreement, Mr. Huffman admitted to downloading child pornography off of websites and newsgroups on the Internet.  Mr. Huffman admitted that some of that pornography depicted prepubescent girls and/or girls under the age of 12 years of age and that some of the child pornography depicted sadistic or masochistic conduct or depicted other forms of violence with respect to the minors.

Judge Alsup sentenced the Defendant to 46 months in federal prison, as well as a three-year period of supervised release.  Judge Alsup also ordered special conditions as part of the supervised release term, one of which included a prohibition on the possession and use of computers with access to the Internet.  Mr. Huffman was also ordered to make application to register as a sex offender pursuant to state law upon his release from prison.  The Defendant will begin serving the sentence on December 5, 2003.

The parties agreed that, under the Sentencing Guidelines, the Defendant could receive a sentence of between 41 and 51 months.  The Court adopted the United States' recommendation that the Defendant receive  a sentence of 46 months under the Sentencing Guidelines.

The prosecution was the result of a investigation by Humboldt County and Fortuna Police Department investigators, as well as Special Agent Christopher Langert and other agents of the Federal Bureau of Investigation.  Kyle F. Waldinger is the Assistant U.S. Attorney who prosecuted the case with the assistance of legal assistant Elaine McCoy.
