The United States Attorney's Office for the Northern District of California announced that John Mark Felder, 34, of Berkeley, was indicted yesterday by a federal grand jury on five counts of bank robbery, in violation of Title 18 United States Code Section 2113(a).  

According to the indictment, within a three week period, Mr. Felder is alleged to have robbed the Citibank at 2000 Shattuck Avenue, Berkeley; the Wells Fargo Bank at 5191 Mowry Avenue, Fremont; the Citibank at 1800 DeCoto Road, Union City; the Washington Mutual Bank at 1870 Solano Avenue, Berkeley; and the World Savings Bank, 3348 Lakeshore Drive, Oakland. 

On July 12, 2004, the San Francisco office of the Federal Bureau of Investigation issued a press release detailing a series of bank robberies and dubbed the robber the "Band-Aid Bandit," and included bank surveillance photographs of the robber wearing a band-aid.    Subsequent investigation led to the filing of a criminal complaint on July 27, 2004 against Mr. Felder for bank robbery, and the return of the indictment yesterday charging Mr. Felder with five counts of bank robbery.

The maximum statutory penalty for each count in violation of 18 U.S.C. § 2113(a)  is 20 years imprisonment, and a fine of $250,000, plus restitution.  However, any sentence following conviction would be dictated by the Federal Sentencing Guidelines, which take into account a number of factors, and would be imposed in the discretion of the Court.  An indictment simply contains allegations against an individual and, as with all defendants, Mr. Felder must be presumed innocent unless and until convicted.

Mr. Felder made his initial appearance in federal court in Oakland on August 30, 2004, where  Mr. Felder was detained without bail. The defendant's next scheduled appearance is at 10:00 a.m. on September 7, 2004, for a detention hearing before Magistrate Judge Wayne D. Brazil.

The prosecution is the result of a three month investigation by Special Agent Todd Dorman, as well as other agents, of the Federal Bureau of Investigation, with the assistance of detectives and officers of the Berkeley Police Department, Fremont Police Department and Vallejo Police Department.  James Keller is the Assistant U.S. Attorney who is prosecuting the case.
