The United States Attorney's Office for the Northern District of California announced today that Shawn Webb Fitzgerald was sentenced  to 105 months in prison for possession of unauthorized access devices.  The sentence was handed down by U.S. District Court Judge Susan Illston following a guilty plea on a violation of 18 U.S.C. § 1029(a)(3).

Mr. Fitzgerald, age 26, a resident of San Francisco, was indicted by a federal grand jury on December 19, 2002.  He was charged with stealing approximately 7,000 pieces of mail, possession and use of unauthorized access devices, and possession of a counterfeit mail box key.

According to the plea agreement, Mr. Fitzgerald admitted that on about December 1, 2001, he began stealing mail from various mail boxes located throughout the Bay Area. Fitzgerald admitted to stealing bank statements with checking account numbers and related information; credit cards; credit card statements with credit card account numbers; stock brokerage statements with brokerage account information; and other financial information.  He also admitted to creating individual files on some of his victims.  The files contained information about the victims' various accounts. In total, Mr. Fitzgerald had over 2,000 different access device numbers in his possession. 

Judge Susan Illston sentenced the Defendant to 105 months in federal prison, restitution of $5,304, as well as a 3 year period of supervised release. The Defendant will begin serving the sentence immediately.

The parties agreed that, under the Sentencing Guidelines, the Defendant could receive a sentence of between 84-105 months.  The Court adopted the United States' recommendation that the Defendant receive  a sentence of 105 months under the Sentencing Guidelines.

The prosecution was the result of a four month investigation by the United States Postal Inspection Service. Anne-Christine Massullo is the Assistant U.S. Attorney who prosecuted the case.
