ENFIELD MAN INDICTED ON DRUG AND WEAPONS CHARGES

Kevin J. O'Connor, United States Attorney for the District of Connecticut, today announced today that a federal grand jury sitting in Hartford yesterday returned an indictment against DAVID CHITTICK, age 20, of 23 South Street, Enfield, Connecticut, on charges of possession with intent to distribute over 50 grams of cocaine base, unlawful possession of a firearm by a convicted felon and possession of a firearm in furtherance of a drug trafficking crime.

The Indictment alleges that on July 20, 2003, CHITTICK possessed with intent to distribute over 50 grams of "crack" and possessed a machine gun in furtherance of the drug trafficking offense. The Indictment further alleges that on December 22, 2003, he possessed a Phoenix Arms .25 caliber semi-automatic pistol, after having been convicted of a felony, that is, Risk of Injury to a Minor on September 20, 2001 in Connecticut Superior Court in Enfield.

If CHITTICK is convicted of the possession with intent to distribute cocaine base charge he faces a mandatory minimum sentence of 10 years and a maximum sentence of life, and a maximum fine of $4 million. If convicted of possessing a machine gun in furtherance of the drug trafficking charge, he faces a mandatory minimum sentence of 30 years, consecutive to his sentence on the drug charges.

"As demonstrated by the mandatory minimum sentences that can result, it should be evident that the federal government and law enforcement authorities takes this level of drug and weapon possession very seriously," U.S Attorney O'Connor stated.

U.S. Attorney O'Connor stressed that an indictment is only a charge and is not evidence of guilt. The defendant is entitled to a fair trial at which it is the government's burden to prove guilt beyond a reasonable doubt.

The case was investigated by Special Agents of the Bureau of Alcohol, Tobacco & Firearms and officers of the Enfield Police Department and is being prosecuted by Assistant United States Attorney Thomas V. Daily.
