On February 22, 2004, Matlock visited the home of his ex-girlfriend, who was entertaining her current boyfriend. During his visit, Matlock, who displayed signs of jealousy in the past, attempted to rekindle his relationship with his former girlfriend. Matlock and the boyfriend, who was a rival gang member, reportedly exchanged words and Matlock produced a handgun. The male victim was shot multiple times, and Matlock fled the scene. The victim suffered from multiple gunshot wounds and died shortly after arriving at the hospital.

On March 2, 2004, a state arrest warrant was issued by the Superior Court of California, County of San Diego, East County Division, charging David Matlock with murder. Matlock was subsequently charged with unlawful flight to avoid prosecution in a federal arrest warrant, which was issued by the United States District Court, Southern District of California, on March 30, 2004.
