Waukegan Fugitive Arrested in Atlanta

Thomas J. Kneir, Special Agent in Charge of the Chicago Office of the Federal Bureau of Investigation (FBI) announced today the arrest of ERNEST MARSALIS, age 41, of Waukegan, Illinois. MARSALIS was arrested earlier today, without incident, by FBI Special Agents and DeKalb, Georgia police officers at a residence in the Atlanta suburb.

MARSALIS has been the subject of a nationwide manhunt by the FBI since June of this year, after being charged in a criminal complaint filed in U.S. District Court in Chicago with Unlawful Flight to Avoid Prosecution (UFAP). These charges stemmed from the March 28, 2002 abduction by MARSALIS of his 8 year old son from an elementary school in Waukegan. Investigation by the Waukegan Police Department determined that MARSALIS might have fled the state, prompting referral to the FBI.

MARSALIS, who is a former Chicago Police Officer, is being held without bond by the DeKalb, Georgia Sheriff's Office, pending return to Waukegan. MARSALIS's son was also recovered unharmed and will be returned to his grandmother in Waukegan, who has court ordered custody of the boy.

The public is reminded that a complaint is not evidence of guilt and that all defendants in a criminal case are presumed innocent until proven guilty in a court of law.
