Azerbaijan

For several years the OSCE Office in Baku implemented projects to help Azerbaijan more fully live up to its OSCE commitments. However, the OSCE Project coordinator’s office was closed at the request of the Government of Azerbaijan in July 2015, and there are no plans to re-open the office at this time.

Azerbaijan has consistently invited the OSCE to observe its parliamentary and presidential elections. However, restrictions placed by the Government of Azerbaijan on OSCE election monitoring teams prior to the November 1, 2015 parliamentary election forced the OSCE to cancel its planned election observation mission.

  • Democracy and Human Rights Trends in Eurasia and East Europe: A Decade of Membership in the Organization

    The ten-year anniversary of the collapse of the Union of Soviet Socialist Republics (USSR), an original signatory to the 1975 Helsinki Final Act, fell in 2001. The following year marked another milestone, perhaps less widely noticed: the passage of a decade since the entry of the Eurasian and East European States into the Organization for Security and Cooperation in Europe (OSCE)*, which embraces all of Europe, the former Soviet Union, the United States and Canada. Membership in the now 55-nation organization is predicated on the acceptance of certain bedrock principles of democracy, a wide array of human rights commitments and modern norms of statecraft, including respect for the rule of law and promotion of civil society. Each of the OSCE participating States, including those examined in this report, has committed to “build, consolidate and strengthen democracy as the only system of government of our nations.� Similarly, the participating States have declared that “human rights and fundamental freedoms are the birthright of all human beings, are inalienable and are guaranteed by law. Their protection and promotion is the first responsibility of government. Respect for them is an essential safeguard against an over-mighty State.� In a step designed to preserve the unity of the Helsinki process, each new participating State submitted a letter accepting in their entirety all commitments and responsibilities contained in the Helsinki Final Act, and all subsequent documents adopted prior to their membership (see Appendix I). To underscore this continuity, the leaders of each of the countries signed the actual original Final Act document (see Appendix II).

  • Human Rights and Inhuman Treatment

    As part of an effort to enhance its review of implementation of OSCE human dimension commitments, the OSCE Permanent Council decided on July 9, 1998 (PC DEC/241) to restructure the Human Dimension Implementation Meetings periodically held in Warsaw. In connection with this decision - which cut Human Dimension Implementation Meetings from three to two weeks - it was decided to convene annually three informal supplementary Human Dimension Meetings (SHDMs) in the framework of the Permanent Council. On March 27, 2000, 27 of the 57 participating States met in Vienna for the OSCE's fourth SHDM, which focused on human rights and inhuman treatment. They were joined by representatives of OSCE institutions or field presence; the Council of Europe; the United Nations Development Program;  the United Nations High Commissioner for Refugees;  the International Committee of the Red Cross; and representatives from approximately 50 non-governmental organizations.

  • Developments in the Chechen Conflict

    Since renewal of the Chechen war in late 1999, the conflict has been characterized by brutality and violations of human rights on both sides, especially on the part of the Russian military with its greater firepower. Hundreds of Chechens, especially males of military age, have been killed or have disappeared as a result of Russian military “sweeps.� An estimated 150,000 – 200,000 civilians have been forced to relocate to neighboring refugee camps. Moscow contends that the war in Chechnya is an integral part of the war against international terrorism, and the U.S. Government has confirmed links between some insurgents in Chechnya and “various terrorist organizations and mujahidin.� The U.S. Government has called upon Chechnya’s leadership to “immediately and unconditionally cut all contacts with international terrorist groups,� while calling for “accountability for human rights violations on all sides� and a political solution to the conflict.

  • Re-Registration Campaign Denying Religious Freedom in Azerbaijan

    Mr. Speaker, the ongoing re-registration campaign for religious organizations conducted by the State Committee for Relations with Religious Organizations, headed by Chairman Rafik Aliev potentially violates Azerbaijan’s commitments to religious freedom as a participating State in the Organization for Security and Cooperation in Europe (OSCE). Azerbaijan must take steps commensurate with its commitments under the Helsinki Final Act and subsequent OSCE documents to ensure the freedom of the individual to profess and practice their religion or belief, alone or in community with others. The State Committee, created last year to replace the Religious Affairs Directorate, has broad administrative powers, which Chairman Aliev seems willing to utilize in an attempt to ban minority religious communities through denial of legal registration. Recent reports indicate that of the 407 religious groups previously registered, only approximately 150 are currently under consideration for re-registration by the State Committee. An additional 200 organizations were unsuccessful in their initial application due to technical errors and were asked to resubmit these requests. While I am pleased that 80 groups have been approved, reportedly most are Muslim, I hope that the State Committee is not specifically discriminating against minority faiths or religious groups. Despite the extension of the re-registration deadline to the end of March, there is legitimate concern that groups will be arbitrarily denied registration, and thereby legal status, despite fulfilling all requirements. In addition, although this is the third registration campaign since 1991, reportedly about 2,000 more religious groups remain unregistered. Recently, a senior official at the State Committee declared unregistered groups will be closed down. The fear that the State Committee will refuse to register religious groups for arbitrary reasons is supported by several statements from Chairman Aliev himself. For instance, he declared the State Committee hoped to introduce more stringent regulations to govern both religious organizations and individuals. He also said the State Committee can request a court to suspend activities of any religious organization conducting activities deemed illegal or found to undermine national security. The State Committee has also limited the ability for religious communities to import religious material. Reportedly, Chairman Aliev also stated “religious organizations must be controlled� and that “religion is dangerous.� This flies in the face of President Heydar Aliyev’s November 1999 public statements supporting religious freedom in Azerbaijan. Also of concern are the heavy-handed actions against religious groups by Azeri Government officials and police officers. For example, on January 18, 2002, National Security Ministry officers raided an unregistered Protestant church, Living Stones, which was meeting in a private apartment. The police and security officers searched the residence and seized religious literature. Ten individuals who were attending the meeting were taken into custody, transferred to a police station and interrogated. While eight individuals were released, two church leaders, Yusuf Farkhadov and Kasym Kasymov, were given two-week prison sentences for violating Article 310 of the Administrative Code, which addresses “petty hooliganism.� The reported justification for the raid was that the church is not registered. However, Living Stones had attempted to register with the government, but only after one and a half years of waiting did the government decide their application contained errors and must be resubmitted. In addition, the church is listed as a branch of the Nehemiah Protestant Church, which is registered. Many other religious communities are also concerned. It is feared the Ashkenzai Jewish community will not be successful in registering, because the State Committee is favoring a separate Jewish group. The liquidation suit brought by Chairman Aliev against the Love Baptist Church in the Narimanov district court continues to drag on. Liquidating the church due to alleged statements by its pastor is a disproportionate penalty and contravenes OSCE commitments. Illegal closures of churches by local officials, as in the case of the Gyanja Adventist Church on February 24, 2002, have not been halted by the State Committee. The closure of mosques under the pretext of state security is also a concern, as the government could ban unpopular groups, despite no proof of illegal activity. The Helsinki Final Act commits that “the participating States will recognize and respect the freedom of the individual to profess and practice, alone or in community with others, religion or belief acting in accordance with the dictates of his own conscience.� Mr. Speaker, I urge President Aliyev to ensure that the re-registration process is accomplished in accordance with Azerbaijan’s OSCE commitments. In light of statements by Chairman Aliev, it is apparent the State Committee is perverting the re-registration process to arbitrarily deny legal registration to selected religious communities. The government must take the necessary steps to protect the right of individuals to profess and practice their faith by registering religious organizations, in keeping with Azerbaijan’s commitments as a participating OSCE State. In closing, Mr. Speaker, I am greatly alarmed by the re-registration campaign in Azerbaijan. This being the third time in a decade the government has required registration, it would seem Azerbaijan will continually “sift� minority religious groups until all are made illegal. Therefore, it is my hope that the Azeri Government will choose to honor its OSCE commitments and allow religious communities to register without harassment or bureaucratic roadblocks. Members of Congress will be watching to see if groups highlighted in this statement are harassed because of their mention.

  • Helsinki Commission Examines U.S. Policy toward the OSCE

    By Erika B. Schlager, CSCE Counsel for International Law On October 3, the Helsinki Commission held a hearing on "U.S. Policy toward the OSCE." Originally scheduled for September 12, the hearing was postponed after the September 11 terrorist attacks. This hearing was convened to examine U.S. priorities and human rights concerns in the OSCE region; how the OSCE can serve to advance those goals and address human rights violations; the pros and cons of the institutionalization and bureaucratization of the OSCE and field activities; and the openness and transparency of the Helsinki process. Helsinki Commission Chairman Senator Ben Nighthorse Campbell (R-CO), Commissioners Rep. Benjamin L. Cardin (D-MD), and Rep. Robert B. Aderholt (R-AL) heard from four witnesses: A. Elizabeth Jones, Assistant Secretary of State for European Affairs; Lorne W. Craner, Assistant Secretary of State for Democracy, Human Rights, and Labor (who has since been formally appointed by the President as one of the three executive-branch Commissioners); Ambassador Robert Barry, former Head of OSCE Mission to Bosnia-Herzegovina; and P. Terrence Hopmann, professor of political science at Brown University and research director of the Program on Global Security at the Thomas J. Watson Jr. Institute for International Studies. Catherine Fitzpatrick, Executive Director of the International League for Human Rights, had agreed to participate in the hearing as originally scheduled for September 12, but was unable to attend on October 3. In her prepared statement, Assistant Secretary Jones described the OSCE as an important tool for advancing U.S. national interests “by promoting democracy, respect for human rights and fundamental freedoms, arms control and confidence building measures, economic progress, and responsible or sustainable environmental policies.� While portraying the OSCE as “the primary instrument for early warning, conflict prevention, crisis management, and post-conflict rehabilitation in [the] region,� she also argued that “it is not the forum for discussion or decision regarding all security issues� – a role implicitly reserved for NATO. Jones alluded to a possible role for the OSCE in combating terrorism, an issue that will be taken up at the OSCE Ministerial, scheduled for December 3 and 4 in Bucharest. In this connection, Chairman Campbell urged the State Department to pursue an OSCE meeting of Ministers of Justice and Interior as a step toward promoting practical cooperation in fighting corruption and organized crimes, major sources of financing for terrorist groups. Assistant Secretary Craner tackled an issue of key concern to human rights groups: would the war against terrorism erode efforts to promote democracy and human rights, particularly with respect to Central Asian countries that are now key U.S. allies in that war? Craner observed that “[s]ome people have expressed concern that, as a result of the September 11 attack on America, the Administration will abandon human rights. I welcome this hearing today to say boldly and firmly that this is not the case. Human rights and democracy are central to this Administration’s efforts, and are even more essential today than they were before September 11th. They remain in our national interest in promoting a stable and democratic world. We cannot win a war against terrorism by stopping our work on the universal observance of human rights. To do so would be merely to set the stage for a resurgence of terrorism in another generation.� The testimony of the two expert witnesses, Professor Hopmann and Ambassador Barry, examined the operational side of the OSCE, with particular focus on the field work of the institution. Hopmann, one of a small number of analysts in the United States who has written in depth about the work of the OSCE and who served as a public member on the U.S. Delegation to the OSCE Review Conference in Istanbul in 1999, offered several specific recommendations: 1) enhance the professional qualifications and training of its mission and support staff; 2) strengthen its capacity to mediate serious conflicts that appear to be on the brink of violence or that have become frozen in the aftermath of violence, including making better use of ‘eminent persons’ to assist these efforts; and 3) attract more active support from its major participating States, especially from the United States, to strengthen the OSCE's capacity to intervene early in potentially violent conflicts when diplomacy still has a chance to win out over force. Ambassador Barry drew on his experience as head of one of the OSCE’s largest missions to address the complex issue of the OSCE’s relations with other international organizations. Barry asserted that OSCE has, at times, “bitten off more than it can chew� and the United States needs to exercise discretion in assigning tasks to the OSCE. When asked specifically to describe the relationship between the OSCE and the Council of Europe, he characterized it as “permanent struggle.� He suggested that the two organizations should not compete with other, but play to their relative strengths: the OSCE, for example, should be dominant in field missions, while the Council of Europe should be given the lead in providing expert advice on legislative drafting. One area where the OSCE is underutilized is in the area of policing – the focus of a Commission hearing held on September 5, 2001. Barry remarked, “Last month several witnesses testified before the Commission concerning the OSCE role in police training and executive policing. With its requirement of universality, the [United Nations] must call upon police who are unable or unwilling to deal with terrorism or human rights violations at home. We cannot expect them to be much help, for example, in dealing with mujahedin fighters in Bosnia or Macedonia. Therefore I believe the OSCE ought to be the instrument of choice for both police training and executive policing. In order to fill the latter role the OSCE should change its policy on arming executive police. Unarmed international police have no leverage in societies where every taxi driver packs a gun.� Barry also argued that the United States needs to involve the Russian Federation more closely with OSCE. “Too often in the past,� he said, “we have marginalized Russia by making decisions in NATO and then asking OSCE to implement the decisions. Macedonia is only the most recent example.� Many of the questions raised by Commissioners focused on institutional issues such as the transparency of the weekly Permanent Council meetings in Vienna, the respective roles of the Chair-in-Office and Secretary General and pressure to enlarge the OSCE’s bureaucracy by establishing new high-level positions to address whatever is, at the moment, topical. State Department witnesses were asked several questions relating to specific countries where human rights issues are of particular concern, including Turkmenistan, a country whose human rights performance is so poor that some have suggested it should be suspended from the OSCE, and Azerbaijan, a country engaged in a significant crackdown against the media. Assistant Secretary Jones argued that, when faced with an absence of political will to implement OSCE human dimension commitments, it is necessary to “persevere� and to hold OSCE participating States accountable for their actions. Noting that the death penalty is the human rights issue most frequently raised with the United States, Commissioner Cardin asked Assistant Secretary Craner how the United States responds to this criticism and whether the use of capital punishment in the United States impacts our effectiveness. Craner noted that the death penalty in the United States is supported by the majority of Americans, in a democratic system, and that the quality of the U.S. judicial system ensures its fairness. He also argued that it does not affect the credibility of the United States on human rights issues. Professor Hopmann, however, disagreed with this assertion. Based on extensive contacts with European delegates to the OSCE in Vienna, Hopmann observed that Europeans find it difficult to reconcile the U.S. advocacy on human rights issues with a practice Europeans view as a human rights violation. Chairman Campbell recommended that similar hearings be convened on a periodic basis to update Congress and the American people on the ongoing work of the OSCE and how it advances U.S. interests across the spectrum of the security, economic, and human dimensions.

  • Report on Azerbaijan's Parlimentary Elections

    On November 5, 2000, Azerbaijan held its second parliamentary election since gaining independence. The Central Election Commission [CEC] reported that turnout was 68.8 percent. In the proportional voting for 25 of the parliamentÂ’s 125 seats, President Heydar Aliev'Â’s party— Yeni [New] Azerbaijan— [YAP] came in first, with 62.5 percent. Only three other parties passed the sixpercent threshold: the Azerbaijan Popular Front “Reformers,” (10.8 percent); the Civic Solidarity Party (6.3 percent); and the Communist Party (6.28 percent). Yeni Azerbaijan, along with nominally independent, pro-presidential candidates, also took most of the 100 seats decided in single-mandate districts, giving AlievÂ’s party about 90 percent control of parliament. The victory of Yeni Azerbaijan was a foregone conclusion. During the registration period, the CEC excluded two opposition parties, Musavat and the Azerbaijan Democratic Party [ADP], for allegedly not having 50,000 valid signatures. International observation missions judged that AzerbaijanÂ’s elections in 1995 (parliamentary), 1998 (presidential) and 1999 (local) all failed to meet international norms. All Azerbaijani opposition parties have denounced the election as rigged. Most opposition parties, however, refused to take part in the January 7 repeat elections. After negative judgements by international observers of four elections since 1995, it is fair to say that Azerbaijan has made no real progress in conducting elections that allow voters to determine who governs them. Despite some improvements on January 7, the electionÂ’s outcome was decided in November through massive falsification, which  left government-opposition relations at a low point. At the same time, the opposition is more fractured than ever. Its leaders were unable or unwilling before the November 5 first round to present President Aliev and Yeni Azerbaijan with a united front and party list.  

  • Roadblock to Religious Liberty: Religious Registration

    The United States Helsinki Commission conducted a public briefing to explore the issue of religious registration, one of many roadblocks to religious liberties around the world, focusing on religious registration among the 55 nations of the Organization for Security and Cooperation in Europe. The troubling trend followed by several OSCE participating states toward restricting the right to freedom of religion by using registration schemes, making it virtually impossible for citizens to practice their faith was addressed. Panelists at the event – including Dr. Sophie van Bijsterveld, Co-Chair of the OSCE/ODIHR Advisory Panel of Experts on Freedom of Religion or Belief; Dr. Gerhard Robbers, Member of the OSCE/ODIHR Advisory Panel of Experts on Freedom of Religion or Belief; Vassilios Tsirbas, Senior Counsel for the European Centre for Law and Justice; and Col. Kenneth Baillie, Commanding Officer of the Salvation Army-Moscow – discussed the various ways governments are chipping away at religious liberty. New legislation concerning religious registration policies that could potentially stymie religious freedom within the OSCE region was also addressed.

  • Elections in Azerbaijan

    Mr. Speaker, on November 5, parliamentary elections were held in Azerbaijan. In anticipation of those elections, the Helsinki Commission, which I chair, held hearings in May, at which representatives of the government and opposition leaders testified. While the former pledged that Baku would conduct a democratic contest, in accordance with OSCE standards, the latter warned that Azerbaijan's past record of holding seriously flawed elections required the strictest vigilance from the international community and pressure from Western capitals and the Council of Europe, to which Azerbaijan has applied for membership. Subsequently, I introduced a resolution, H. Con. Res. 382, which called on the Government of Azerbaijan to hold free and fair elections and to accept the recommended amendments by the OSCE's Office of Democratic Institutions and Human Rights (ODIHR) to the law on elections.   From the start, there was pressure to withdraw the resolution from the Azerbaijani government and others. They argued that President Aliev had made, or would make, the necessary changes to ensure that the election met international standards, claiming to render the resolution either irrelevant or out of date. That pressure intensified as the election drew near; in fact, the resolution never came to a vote before Congress went out of session in early November.   It is worth recalling this brief history in light of what actually happened during Azerbaijan's pre-election period and on November 5. With respect to the election law, one of ODIHR's concerns was ultimately addressed by a decision of Azerbaijan's constitutional court, but on other important issues, Baku rejected any concessions and refused to incorporate ODIHR's suggested changes. From the beginning, therefore, the election could not have met OSCE standards, as ODIHR made plain in several statements. During the registration period, the Central Election Commission (CEC) rejected several leading opposition parties. Claiming that government experts could tell which signatures were forged, fraudulent or otherwise invalid merely on the basis of a visual examination, the CEC maintained the Musavat and the Azerbaijan Democratic Party had failed to get 50,000 valid signatures. The same thing happened to Musavat in the 1995 parliamentary election. At that time, the OSCE/UN observation mission emphasized the need to amend or get rid of this obviously flawed method of determining the validity of signatures, but Azerbaijan's authorities did not heed that advice. The exclusion of leading opposition parties drew strong criticism, both inside and outside the country, including the OSCE and the U.S. Government.   In early October, in apparent reaction to international concern, President Aliev “appealedâ€? to the CEC to find some way of registering excluded opposition parties. Some CEC members objected, arguing there was no constitutional basis for such a presidential appeal or a changed CEC ruling, but the Commission moved to include opposition parties. Though their participation certainly broadened the choice available to voters, the manner of their inclusion demonstrated conclusively that President Aliev controlled the entire election process. ODIHR welcomed the decision by the CEC and urged a reconsideration of the exclusion of over 400 individual candidates, about half of those who tried to run in single-mandate districts. But the CEC did not do so, and only in very few cases were previously excluded candidates allowed to run. As 100 of parliament's 125 seats were determined in single mandate districts, where local authorities exercise considerable power, the rejection of over 400 candidates signaled the government's determination to decide the outcome of the vote.   Though coverage of the campaign on state media favored the ruling party, opposition leaders were able to address voters on television. They used the opportunity, which they had not enjoyed for years, to criticize President Aliev and offer an alternative vision of governing the country. Their equal access to the media marked progress with respect to previous elections, as noted in the ODIHR's election report.   However, this voting and vote count on election day itself, according to the ODIHR's election, would be bad enough, considering that the election was the fourth since 1995 that failed to meet OSCE standards, even if some progress was registered in opposition participation and representation in the CEC. Much more interesting and disturbing, however, were the words used in a post-election press conference by two key international observers: Gerard Stoudman, the Director of ODIHR, who generally employs measured, diplomatic language, said he had not expected to witness “a crash course in various types of manipulation,â€? and actually used the phrase “primitive falsificationâ€? to describe what he had seen. Andreas Gross, the head of the observer delegation of the Council of Europe, an organization to which Azerbaijan has applied for membership and which is not particularly known for hard-hitting assessments of election shenanigans, amplified: “Despite the positive changes observed in Azerbaijan in recent years, the scale of the infringements doesn't fit into any framework. We've never seen anything like it.â€?   Mr. Speaker, in the context of international election observation, such a brutally candid assessment is simply stunning. As far as I know, representatives of ODIHR or the Council of Europe have never expressed themselves in such terms about an election that they decided to monitor. One senses that the harshness of their judgment is related to their disappointment: Azerbaijan's authorities had promised to conduct free and fair elections and had long negotiated with the ODIHR and the Council of Europe about the legal framework and administrative modalities but, in the end, held an election that can only be described as an embarrassment to all concerned. According to Azerbaijan's CEC, in the party list voting, only four parties passed the six-percent threshold for parliamentary representation: President Aliev's governing party, the New Azerbaijan Party; the Communist Party; and two opposition parties, the Popular Front (Reformers) and Civil Solidarity. Other important opposition parties allegedly failed to break the barrier and apart from a few single mandate seats won no representation in parliament. In the aftermath of the election and the assessments of the OSCE/ODIHR and the Council of Europe, the international legitimacy of Azerbaijan's legislature is severely undermined. Within Azerbaijan, the ramifications are no better.   All the leading opposition parties have accused the authorities of massive vote fraud, denounced the election results, and have refused to take the few seats in parliament they were given. Though some governing party representatives have claimed that opposition representation is not necessary for the parliament to function normally, others, perhaps including President Aliev, understand that a parliament without opposition members is ruinous for Azerbaijan's image. New elections are slated in 11 districts, and perhaps President Aliev is hoping to tempt some opposition parties to abandon their boycott by offering a few more seats. Whether opposition parties, which are bitterly divided, will participate or eventually agree to take up their deputies' mandates remains to be seen. What is clearer from the conduct of the election and its outcome is that President Aliev, who is preparing the succession of his son as Azerbaijan's next president, was determined to keep opposition leaders out of parliament and ensure that the body as a whole is supportive of his heir. If the only way to guarantee the desired outcome was wholesale vote fraud, so be it.   Prognoses of possible accommodation with the opposition, or possibly even some power sharing arrangements, to facilitate a smooth and peaceful transfer of power, have proved unfounded. Indeed, President Aliev reportedly has told the new UK Ambassador to Baku that Azerbaijan does not need to join the Council of Europe, indicating that he is not prepared to make any concessions when it comes to maintaining his grip on power and passing it on to his chosen heir, whatever the international community thinks. Even more worrisome is that by depriving the opposition of the possibility to contend for power through parliamentary means, Aliev has seriously reduced the chances of a “soft landingâ€? in Azerbaijan. When he eventually leaves the scene, anything could happen. This is not only a frightening prospect for the citizens of Azerbaijan, its neighbors and hopes for resolving regional disputes, especially the Nagorno-Karabakh conflict, it is a scenario that should alarm policymakers in Washington as well.   Mr. Speaker, it is not my intention to say “I told you soâ€? to those colleagues who argued against my resolution. I would much have preferred to make a statement congratulating Azerbaijan on having held exemplary elections and making substantial steps towards democratization. Alas, I cannot do so, which should sadden and concern all of us. But I fear the consequences will be far more serious for the citizens of Azerbaijan.

  • U.S. Statements at the 1999 OSCE Review Conference

    In February 1999, officials from 90 governments, including representatives from many OSCE participating States, visited Washington for the First Global Forum on Fighting Corruption among justice and security officials. Participants concluded that their governments must cooperate more closely if they were to succeed in promoting public integrity and controlling corruption among their officials. OSCE efforts served as an example to others when the international community gathered in the Netherlands in 2001 for the Second Global Forum on Fighting Corruption.

  • Azerbaijan's Parliamentary Elections

    Mr. Speaker, today I introduce a resolution calling on the Government of Azerbaijan to hold free and fair parliamentary elections this November. After a series of elections marred by irregularities, the upcoming election will help define the country's political orientation and its international reputation. Is Azerbaijan developing towards Western-style electoral democracy or mired in the Soviet pattern of controlled voting results? The answer to that question is important for the United States, which has significant strategic and economic interests in Azerbaijan.   At age 77, Azerbaijani President Heydar Aliev is the most experienced politician in the former Soviet space. Since returning to power in 1993, he has created a semi-authoritarian political system that features highly centralized, hands-on presidential rule, with constant positive coverage in the state-run media. President Aliev controls all branches of government and the state's instruments of coercion. His implicit bargain with Azerbaijan's citizens offers stability in return for unquestioned predominance. While Azerbaijan's constitution enshrines separation of powers, neither the legislature, judiciary, press, nor opposition parties may challenge President Aliev's hold on power. Indeed, in an interview published in last Sunday's New York Times, he openly said, `I will always be president here.' Opposition parties function, publish newspapers and have some representation in parliament. But they have no access to state media, which portray them negatively, and their opportunities to influence the political process, let alone actual decision-making, are carefully restricted.   With respect to elections, Azerbaijan's record has been poor. The OSCE's Office for Democratic Institutions and Human Rights (ODIHR) monitored the 1995 and 1998 parliamentary and presidential elections, and concluded that they did not meet OSCE standards. Council of Europe observers harshly criticized the first round of the local elections in December 1999, though they noted some improvements in the second round. These flawed elections have exacerbated the deep distrust between the government and opposition parties.   On May 25, the Helsinki Commission, which I chair, held hearings on the upcoming election, in which Azerbaijani Government representatives and opposition leaders participated. At that time, the main bone of contention between them was the composition of the Central Election Commission. During the hearing, a government spokesman announced that Baku was prepared to let government and opposition members veto the other side's nominees for the Commission posts set aside for independents, a major step forward. In fact, that assurance subsequently turned out to be not entirely reliable when the hard bargaining began in Baku, with the mediation of the ODIHR. Nevertheless, the agreement eventually reached did give opposition parties an opportunity to block decisions taken by the pro-presidential majority and was acclaimed by ODIHR as a fair and necessary compromise.   Since then, unfortunately, the process has collapsed. Azerbaijan's parliament passed an election law on July 5 that did not include amendments recommended by the ODIHR to bring the legislation into accord with OSCE standards. The law excludes an opposition party registered in February 2000 from fielding a party list; other problematic aspects include territorial and local election commissions which are effectively under government control, the restriction of voters' rights to sign petitions nominating more than one candidate or party, and the right of domestic observers to monitor the election. President Aliev claims that he proposed modifications to the election law but parliament refused to accept them. This assertion, considering his hold on the legislature, where a loyal, pro-presidential party controls over 80 percent of the seats, is simply not plausible. In any case, if he did not approve of the law, he could have vetoed it. Instead, he signed it.   On July 7, the ODIHR issued a press release `deploring' shortcomings in the election law. Opposition parties refused to participate in the work of the Central Election Commission unless the law is changed. In response, parliament amended the Central Election Commission law, depriving the opposition of the ability to block decisions. On July 20, 12 political parties, among them the leading opposition parties, warned that if parliament refuses to amend the election law, they will boycott the November ballot. Most recently, the State Department issued a statement on July 24, regretting the recent actions of Azerbaijan's parliament and urging the government and parliament in Baku to work with ODIHR, the opposition and non-governmental organizations to amend the election law in accordance with OSCE standards. Mr. Speaker, this turn of events is extremely disappointing. The last thing Azerbaijan needs is another election boycott by opposition parties. The consequences would include a parliament of dubious legitimacy, deepened distrust and societal polarization, and a movement away from electoral politics to street politics, which could threaten the country's stability.   November's election offers a historic opportunity to consolidate Azerbaijani society. It is essential for the future development of Azerbaijan's democracy and for the legitimacy of its leadership that the election be free and fair and the results be accepted by society as a whole. This resolution calls on the Administration to remind President Aliev of the pledge he made in August 1997 to hold free and fair elections, and urges Azerbaijan's Government and parliament to accept ODIHR's recommendations on the election law, so that it will meet international standards. I hope my colleagues will join me, Mr. Hoyer, Mr. Pitts and Mr. Cardin in this effort, and we welcome their support.

  • Torture in the OSCE Region

    In advance of the 2000 commemoration of the United Nations Day in Support of the Victims of Torture, the Helsinki Commission held a briefing to focus on the continuing problem of torture in the OSCE region. In spite of these efforts and the efforts of our Commission, including introducing and working for passage of two bills, the Torture Victims Relief Act and the Reauthorization of the Torture Victims Relief Act, torture continues to be a persistent problem in every OSCE country including the United States. This briefing considered two specific problem areas, Chechnya and Turkey, as well as efforts to prevent torture and to treat torture survivors. Witnesses testifying at the briefing – including Dr. Inge Genefke, International Rehabilitation Council for Torture Victims; Maureen Greenwood, Advocacy Director for  Europe and the Middle East, Amnesty International; and Douglas Johnson, Executive Director of the Center for the Victims of Torture – highlighted statistics about the number of torture victims in Turkey and Chechnya and related violations of individual rights.

  • Elections, Democratization, and Human Rights in Azerbaijan

    The hearing will outline recent developments in Azerbaijani elections. Azerbaijan government officials announced Thursday that Azerbaijan’s government has accepted proposals to agree with the opposition about independent members of the Central Election Commission in advance of the November parliamentary election. The announcement was made during a hearing of the United States Commission on Security and Cooperation in Europe. Azerbaijan’s Ambassador Hafiz Pashayev, accompanied by several experts who arrived from Baku for the hearing, said that negotiations between the sides, with the active mediation of the OSCE’s Office for Democratic Institutions and Human Rights (ODIHR), would continue about the Central Election Commission and the election law. How these electoral developments effect Azerbaijan will be outlined.

  • Baptist Church Targeted by Azerbaijan Authorities

    Mr. Speaker, as Chairman of the Commission on Security and Cooperation in Europe, I rise today to highlight a disturbing incident involving governmental harassment of religious believers in Azerbaijan. We have received reports of religious liberty violations perpetrated by governmental authorities. As a participating State of the OSCE, Azerbaijan has committed to insuring the freedom of individuals to profess and practice their religion. These recent governmental actions are a clear violation of Azerbaijan's OSCE commitment to the freedom of thought, conscience, religion or belief.   On September 5th, government officials in Baku forced their way into a legally-registered church, Baku Baptist Church, and arrested sixty members of the religious group. The pastors of the church as well as a dozen foreigners were among those arrested and interrogated. The arrested Azeri religious believers were detained and asked to sign a statement affirming that they had attended an “illegal meetingâ€? and promising not to attend the religious meetings in the future. Ultimately, two leaders of the church were sentenced to 15 days in prison on charges relating to resisting police. Likewise, then other foreign members of the religious group were charged with “engaging in religious propagandaâ€? and “propagating against the Muslim faith,â€? in violation of an Azeri law that forbids such activity. On September 8th, all ten foreigners were deported and more deportations are likely. These events are alarming, Mr. Speaker.   While there had been reports of governmental harassment in the past, especially of unregistered religious minority groups, these current events are especially problematic because the target of these actions was a legally registered religious group. Mr. Speaker, these actions are in direct violation to Azerbaijan's OSCE commitments, including section 16 of the 1989 Vienna Concluding Document, which explicitly delineates the wide scope of activities protected, including the right to establish and maintain places of worship and granting them status under law to both profess and practice their faith. In the 1990 Copenhagen Concluding Document Article 9.1, Azerbaijan has reaffirmed “that everyone will have the right to freedom of expression, including the right to communication. This right will include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.'' The actions by Azerbaijani officials clearly violate these commitments.   I truly hope that these government actions are merely an aberration and will be dealt with accordingly and are not the signal of even more repression of religious believers in Azerbaijan. I would like to commend to my colleagues the work of our Embassy in Baku on religious liberty. Embassy personnel have taken this recent incident very seriously and have followed the situation from the start. I urge those of my colleagues who interact with Azerbaijani Government officials to raise religious liberty issues in their discussions, stressing the essential role that religious liberty--and indeed human rights in general, play in maintaining a free, stable, and democratic civil society.

  • The Sex Trade: Trafficking of Women and Children in Europe and the United States

    This Commission examined an escalating human rights problem in the OSCE region: the trafficking of women and children for the purpose of sexual exploitation. Trafficking in human beings is a form of modern-day slavery. When a woman or child is trafficked or sexually exploited by force, fraud, or coercion for commercial gain, she is denied the most basic human rights enumerated in the Universal Declaration of Human Rights and numerous international human rights agreements. Although trafficking has been a problem for many years in Asian countries, it was not until the end of communism in East-Central Europe and the break-up of the Soviet Union that a sex trade in the OSCE region began to develop. The hearing looked into the U.S. and the global response to this appalling human challenge and what else could be done to address it.

  • The Ombudsman in the OSCE: An American Perspective

    This briefing assessed the role of ombudsmen institutions in the countries of the Organization for Security and Cooperation in Europe from an American perspective. The ombudsman institution was described as a flexible institution; adaptable to national and local government structures in a wide variety of countries, and a brief evaluation of the evolution of this institution was presented. Dean M. Gottehrer, a consultant on ombudsmen in human rights institutions for the United Nations Development Program, Office for Democratic Institutions and Human Rights of the OSCE, and the United States Information Agency, presented a personal analysis of the role of ombudsmen institutions in protecting human rights in OSCE participating states.

  • Report on Azerbaijan's Presidential Election

    On October 11, 1998, Azerbaijan held presidential elections. The contest pitted incumbent President Heydar Aliev, the former Communist Party leader who returned to power in 1993, against moderate opposition leader Etibar Mamedov, political maverick Nizami Suleimanov, and three other candidates with little recognition or following. While no one seriously expected Aliev to lose, the opposition candidates were hoping for a second round. Five leading opposition politicians—Abulfaz Elchibey, Isa Gambar, Rasul Guliev, Ilyas Ismailov and Lala Shovket—boycotted the vote, unwilling to legitimize by their participation an election they believed would be unfair. Negotiations that took place in August between the government and the boycotting opposition over the most controversial aspect of the election—the composition of the Central Election Commission—proved unsuccessful, with the authorities rejecting the opposition’s demand for equal representation on the CEC. The five leaders, joined by numerous other parties and groups in the Movement for Electoral Reform and Democratic Elections, urged voters not to go to the polls. The authorities minimized the boycott’s significance, arguing that the opposition leaders knew they had no chance in a fair election and therefore preferred to claim fraud and not participate. Beginning August 15, the boycotting parties organized a series of rallies and demonstrations to pressure the government and call for fair elections. These were the first mass street actions in Azerbaijan in years. The authorities refused to let the opposition hold a demonstration in Freedom Square, in the center of Baku, offering alternative venues instead. On September 12, protesters clashed with police, resulting in arrests and injuries. Afterwards, authorities and opposition tried to reach agreement on the demonstrators’ route, and most pre-election rallies, some of which drew big crowds, were largely peaceful. The increasingly tense relations between the government and boycotting opposition parties were one factor in the OSCE/ODIHR’s appraisal of the election.  In ODIHR’s view, these failings outweighed the positive aspects of the election, such as the election law, which all sides acknowledged as acceptable, the freedom for candidates to speak openly on television, the abolition of censorship and provisions for domestic observers. The OSCE/ODIHR assessment was that the election fell short of meeting international norms. With the OSCE assessment placing in question the official results, the CEC’s failure to publish election protocols until long after the stipulated time period heightens doubts about President Aliev’s standing. The election was largely a referendum on his five-year presidency. Since his return to power in 1993, he has not solved the major problems besetting the country. The NagornoKarabakh conflict remains unsettled; Azerbaijani territory is still under Armenian occupation and no refugees have returned to their homes. Living standards for the great majority of the population have declined precipitously, though it is widely known that a tiny stratum of corrupt officials and businessmen have become rich. Moreover, the predominance of people from Nakhichevan - Aliev’s home region - in positions of power exacerbates general discontent.

  • Status of Religious Liberty for Minority Faiths in Europe and the OSCE

    The purpose of this hearing, which the Hon. Christopher H. Smith chaired, was to discuss the reality of disturbing undercurrents of subtle, but growing, discrimination and harassment of minority religious believers, as opposed to discussing the widespread documentation of torture and persecution of practitioners of minority faiths. In a number of European countries, government authorities had seemed to work on restricting the freedoms of conscience and speech in much of their governments’ actions. For example, in Russia, on September 26, 1997, President Boris Yeltsin signed the law called “On Freedom of Conscience and on Religious Associations,� which blatantly violated agreements of the OSCE which the former U.S.S.R. helped to initiate. Through use of witnesses, then, attendees of this hearing, namely commissioners, gained a deeper understanding of the religious liberty violations within OSCE member countries and insight into how to best influence governments to adhere more closely to internationally accepted human rights standards.

  • Treaty on Conventional Armed Forces in Europe (CFE)

    This briefing focused on the topics of European security and NATO enlargement, specifically in terms of the Treaty on Conventional Armed Forces in Europe. Elements of the treaty that remained especially important, including the goal of avoiding destabilizing concentrations of forces in Europe and the goal of creating greater transparency and promoting information exchange among governments in Europe, were discussed. Witnesses testifying at this briefing spoke to the need for amendments and changes to the CFE, but maintained the relevance of the treaty to international security. Different strategies for making these changes related to Russian pressure and NATO involvement were presented. 

  • U.S. Statements on the Human Dimension, 1996 OSCE Vienna Review Conference and Lisbon Summit

    This compendium of statements illustrates the U.S. perspective that one of the key and distinguishing features of the OSCE is the interlocking framework of critical, politically binding commitments which provide a common set of principles to which all participating States can aspire. The OSCE draws its real strength and practical flexibility from participating states' commitments to the values of the original Helsinki Act, rather than from a legalized, treaty-based institutional structure. A fundamental strength of the OSCE is the review process, which provides a regular opportunity to assess a participating states' efforts to further the realization of the Helsinki Accords within its own borders, and in its relations with other OSCE states. The OSCE is increasingly a pillar of European security. By facilitating honest implementation review the OSCE can strengthen security links based on common values.

  • Report: US Helsinki Commission Delegation to Georgia and Azerbaijan

    From April 22-26, 1996, Commission staff attended, along with 30 media professionals, the International Conference on Conflict in Trans-Caucasus [sic] and the Role of Mass Media, held in Kobuleti, Ajaria (an Autonomous Republic in Georgia). The conferences organizers were the OSCE Office of Democratic Institu- tions and Human Rights (ODIHR), the OSCE Mission to Georgia, the Council of Europe and the Tbilisi-based Black Sea Press Information Agency. The project was co-sponsored by the U.S. Agency for International Development, through the Eurasia Foundation. Participants came from Baku, Tskhinvali (South Ossetia), Stepanakert (Nagorno-Karabakh), Tbilisi and Yerevan. Organized by the ODIHR as a follow-up to the 1995 Human Dimension Implementation Review Meeting in Warsaw, the conference was one in a series on the role of the media in conflict situations and in systems undergoing the transition from communism. The stated aim of these conferences is to develop aware- ness of and working recommendations for the journalists working in conflict regions on the role the media can play in preventing and resolving conflicts. A secondary goal is to give journalists from states or regions in conflict the opportunity to meet, discuss common problems and establish personal contacts to promote the exchange of information. Other scheduled conferences examine the role of the media in the former Yugoslavia (June 1996) and the situation of the media in Uzbekistan (October 1996). One important reason conference organizers chose Kobuleti was that Ajaria has managed to avoid the destruction and disruption visited upon the rest of Georgia in the last several years by ethnic conflicts and by gangs of marauding criminals associated with various paramilitary groups. Under the iron grip of Aslan Abashidze, the Chairman of Ajarias Supreme Soviet, Ajaria has been relatively calm, and has taken in refugees from Georgias ethnic-separatist conflicts in Abkhazia and South Ossetia. Since these conflicts are technically unre- solved, Tbilisi, the capital, would have been problematic for Abkhaz and South Ossetians, whereas Ajaria seemed a more neutral site.
