H.AMDT.94 (A002) Substitute amendment

AMENDMENT DESCRIPTION:
Amendment in the nature of a substitute sought to provide for a 10-week moratorium on the hiring of permanent replacements for workers striking over economic issues; allow the employer to hire permanent replacements after the 10-week period had expired; require the NLRB to treat all unfair labor practice charges filed by the parties as a priority; extend from 12 to 18 months the time in which permanently replaced workers would be eligible to vote in union decertification elections; and require a secret vote before a union can call an economic strike.

AMENDMENT PURPOSE:
An amendment in the nature of a substitute that would prohibit--for a 10 week period--employers from hiring permanent replacements for workers striking over economic issues. This 10-week period would begin when an employer hires temporary replacements. Under the substitute, the employer would be free to hire permanent replacements after the 10-week period had expired. During the 10-week period, the NLRB would treat all unfair labor practice charges filed by the parties as a priority, and investigate and if possible and warranted, issue complaints within the 10-week period. The substitute also directs the Federal Mediation and Conciliation Services to offer its services in an economic strike once temporary replacement workers have been hired. It extends from 12 months to 18 months the period of time during which replaced employees are eligible to vote in any election involving employees of the bargaining unit, and requires a secret vote before a union can call an economic strike.
