Jenkins Requests KS Attorney General to Challenge Constitutionality of Democrat's Health Care Bill

WASHINGTON – Congresswoman Lynn Jenkins today sent a letter to Kansas Attorney General Steve Six requesting he join other state attorney’s in challenging the constitutionality of H.R. 3590, the Democrat’s health care bill.
 
“I believe the Democrat’s government takeover of health care is unconstitutional. That is why I have asked Kansas Attorney General Six to join his colleagues around the nation in challenging the constitutionality of this legislation and to protect Kansans from this massive intrusion by the federal government.
 
“Article 1, Section 8 of the U.S. Constitution gives Congress the power “to regulate commerce with foreign nations, and among the several states, and with the Indian tribes.” But, nowhere in the U.S. Constitution did our founding fathers give Congress the authority to regulate commerce between individuals. Requiring all citizens to purchase health insurance or pay a penalty for failing to do so appears to be in violation of that clause.
 
“For the past 223 years, the U.S. Constitution has provided power to the federal government, but it has also set equally important restrictions on that power. Specifically, the 10th Amendment to the U.S. Constitution protects state sovereignty. I am concerned by centralizing health care decision-making in Washington and removing that power from local entities, the federal government is exercising powers not granted to it through the U.S. Constitution.”
