S. 330, the "HIV Organ Policy Equity (HOPE) Act"
S. 330 updates the National Organ Transplant Act in light of current medical and scientific understanding of HIV and AIDS. The legislation lays the foundation for HIV-positive to HIV-positive organ donation to occur in the future, first beginning with thorough research. The Secretary of Health and Human Services (HHS) will spearhead the development of research criteria for HIV-positive to HIV-positive organ donation, conduct an annual review of the subsequent research results, and if necessary, direct the Organ Procurement and Transplant Network to make revisions to organ transplantation standards of HIV-infected organs.
The HOPE Act was first considered by the Committee in markup on July 16, 2013, as its House companion bill, H.R. 698. The House ultimately voted on S. 330 on November 12, 2013, and passed the legislation by voice vote.
On November 21, 2013, S. 330 was signed by President Obama as Public Law 113-51.
