U.S. Senator Lamar Alexander (R-Tenn.) asked Secretary of Labor Hilda Solis during an Appropriations subcommittee hearing about a proposed rule that would effectively eliminate current regulations exempting "companionship services" and "live-in domestic services" from minimum-wage and overtime requirements: "If you put them out of work with higher costs, caused by your overtime rule, they'll really have a hard time making ends meet ... what you're doing is talking about raising the costs of home health care to people who can't really afford it and putting people out of work who can't get the jobs ... what about the answer to my three questions? Did you consult with any Medicaid director in any state about the increased health-care costs? ... Yes or no? ... You don't know?"

    Thank you Senator Lamar Alexander! Another thing that we (home care companies) take advantage of under this exemption is to pay shift rates instead of hourly for 24 hour shifts. The caregiver is not paid when they are sleeping for example. We can bill a 24 hour shift as a shift and not hourly. Without overtime billing hourly verses shifts will also increase the cost to the serniors we serve. Thank you for taking the stand you did.
