Congresswoman Kathy Hochul (NY State 26th District) denies that the Constitution was consulted for Obamacare HHS Mandate. She even implies that constitutionality was not considered for the entire Health Care law.

    This is lot of wasted pontificating, seeing as how the supreme court will make a determination on the constitutionality of the h.c. mandate in a week or so.

    My own view: No one is "forced" to buy insur, since they can legally choose to pay a slightly higher tax instead. The slightly higher tax goes into general revenue to fund government services, including health care (eg: emergency wards).

    Requiring someone to pay money if they do not buy something is forcing them to buy it. If someone comes to your house and removes a wall if you don't buy health insurance I think you would be a little ticked. There is no difference. Secondly, this issue is about forcing a private company to provide a benefit and include in the benefit something they do not believe is in the best interests of health. Stay with the issues at hand and your view will have more staying power.

    God you are so stupid. No one is forcing you to buy h.c. insurance. In fact the only thing different between the taxes you pay for the military etc and the tax you would pay for health care is that in the latter case you have a choice of paying the taxes or buying private insurance.

    Ok irrational, First, I happen to like military protection, roads, courts, fire departments, and police. Second, what is difficult for you to understand about the fact that taxes are a different thing than forcing a private company to pay for something above and beyond their taxes?

    Under your own logic, you are already 'forced" to buy military protection, roads, courts, fire departments, police, educations and on and on.

    So why is health care any less necessary or important?

    I know actually thinking it through will tax your poor neurons, but give it a try.

    And the PATRIOT act is HORRIBLE. Its not about republicans and democrats. Its about the constitution, limited government, and free markets. Republicans these days are just democrats with more aggressive attitudes. They still love socialism and destroying the constitution. Our country has fallen FAR. We need to get back to the constitution and true capitalism. Instead of this socialism / corporate fascism thing we have going on now.

    larrybud is absolutely correct. The federal government does not have the authority to force citizens to buy insurance. It is COMPLETELY unconstitutional. Not only that but it is fascist. If they are going to do something like this (which they absolutely should not in any form be doing) then they should be running the insurance. Govt forcing citizens to buy from private corporations is FASCISM by definition. And is worse than socialism, which is also terrible because it always deteriorates.

    and also its part of their lovely redistribution of wealth. Because they are redistributing the wealth from the middle and lower classes (especially middle since lower aint got much left to give) up to the upper class. Of course they claim its the other way around. But the end result is the destruction of the middle class and the complete takeover of the upper class over the newly expanded lower class.
