On September 12th, 2008, NoBama made the following promise to the American people:

"I can make a firm pledge under my plan, no family making less than $250,000 a year will see any form of tax increase. Not your income tax, not your payroll tax, not your capital gains taxes, not any of your taxes." (emphasis added)

NoBama repeatedly vowed "You will not see any of your taxes increase one single dime.""Income taxes and sales taxes are the go-to taxes when you really need to raise a lot of money,"... including the largest tax increase hits the poor hardest the cigarette tax increase: 62 cents!!!!

    reason to think that a statute applying to any tax would apply to a penalty." Chief Justice Roberts, page 12 of the slip opinion. It may be easier to parse if it's compared to a tax, but it is not a tax.

    Per NPR "The Affordable Care Act, including its individual mandate that virtually all Americans buy health insurance, is constitutional. There were not five votes to uphold it on the ground that Congress could use its power to regulate commerce between the states to require everyone to buy health insurance. However, five Justices agreed that the penalty that someone must pay if he refuses to buy insurance is a kind of tax that Congress can impose using its taxing power."

    A penalty, not a tax. If it were a tax, the court would have found that they couldn't reach this issue because of the Anti-Injunction Act.
