    • Sunset Valley City Council Rejects Offer to Host Olympic Curling Championships An offer was made by USA Curling to bring National Championships and Olympic Trials to the City of Sunset Valley (SSV). This offer was made in support a variance request to build a new state of the art Olympic facility in Sunset Valley’s extra territorial jurisdiction (ETJ). Kim Nawyn, Director of Membership and Growth came to SSV to state that USA Curling, the governing body for the US Olympic Team, was in full support of the proposed Austin Curling Center (ACC). The requested variance was to meet minimum facility qualifications in order to host National Curling Championships including Olympic Trials. Ms. Nawyn stated that should the requested variance be granted, the facility qualified to host at least eight National Curling Championships and other Olympic-style events. In her letter to the Sunset Valley City Council, she states that any one of these events could bring economic benefits to the local community approaching $1,000,000 per event. We were advised by the SSV development board that we needed to request 2 separate variances. The first variance would allow us to join the two adjacent lots into a single property. This variance was required since SSV had no established regulations to allow for this action. SSV was not willing to accept the simple application process required by the City of Austin or by Travis County. The second variance was for an extra 3.9% impervious cover in order to meet minimum Olympic standards for the facility. To offset this variance request, ACC proposed rainwater harvesting as per accepted LCRA offset practices. Also, the roof of the building would be fitted with solar panels to provide power to operate the facility. We were asked to submit a project summary in order to bring the new SSV City Council up to speed on the project. We also met with the SSV development committee four times in order to resolve issues relating to the variance request. Additionally, we submitted all required site plans and drawings to support the variance request a week prior to the Council meeting, as required. We were led to believe that there would be a vote on these variances at the 11/27/12 meeting. At the onset of this meeting, Mayor Cardona stated that no decision would be made in regard to these variances. It was stated that the meeting was mainly to allow City Council to air their questions and concerns in regards to the project. The City Council appeared uninformed about any aspect of our variance request. One council member even stated that this was the first time he had heard of either the Sport of Curling or our proposed Olympic curling facility in SSV. Many of the issues raised by the City Council involved parking and traffic issues. These issues had been resolved in the earlier development committee meetings when it was mutually agreed that SSV had no jurisdiction on these issues. The issue of water utilities was raised and it was suggested by SSV staff that we could connect to the City of Austin utilities at the edge of our property. However, at this variance hearing we were told that there is an “arrangement” with the City of Austin that, if invoked, would require us to connect to the much more distant SSV utilities. In fact, the water utilities currently being supplied to the area are of such poor quality that SSV stated they would require us to rebuild the utility service to the entire ETJ area. In the end, the Mayor refused to have a vote on either variance. She further stated, “Variances are a hurdle and I don’t know if the staff has been clear with you. For us to approve something above 18% without very clear justification, it’s a hurdle. And because it’s in our ETJ, we don’t have the power to control zoning and parking and other things, so this, the variances, really are the one power strike that we have to control anything that happens.” Since our Master Plan indicates that this property is residential, any other use of the property will require an approved variance. The implication is that SSV will continue to reject both the Austin Curling Center and the Olympic Curling Championships. What is not obvious is that the Master Plan was approved and implemented (2011) only after we had initiated discussions with SSV staff over our desire to build such an Olympic facility on our legally designated commercial property. This designation was acquired by the previous owner who had won a legal battle on this very issue and reached a legal settlement that this property is not subject to the residential restrictions of SSV. The settlement suggests that any additional efforts by SSV to implement their residential restrictions could be considered “harmful obstruction” to our property rights. We firmly believe that the implementation and application of the SSV Master Plan to our legally designated commercial property is an attempt to circumvent this agreement and ensure that no future commercial use of this property is possible. ______________________________________ Refer to Sunset Valley City Council meetings videos of 3/1/11 and 11/27/12. This $2,500 annual credit can cover most or all of the expenses at many colleges and assist greatly in paying for more costly programs.
