The House passes the Continuity of Representation Act, but more remains to be done

Washington, DC – U.S. Representative Zoe Lofgren (D-San Jose) released the following statement on the passage of HR 2844, The Continuity of Representation Act of 2004. 

“Today, I voted in support of the Continuity of Representation Act of 2004 (HR 2844). 

“While this legislation is not perfect, it is very important that the country have the ability to conduct accelerated Congressional elections in the event of a catastrophic attack on Congress.  HR 2844 calls for special elections to be held within 45 days of any event that creates more than 100 vacancies in the House of Representatives.  The agreement to the motion to recommit offered by Congressman Mel Watt (D-NC) to keep all voting and civil rights laws in effect played a crucial role in the passage of this legislation. 

“HR 2844 is a step in the right direction.  However, a gaping hole still exists because temporary appointments are not part of this solution.  The House must have the ability to function in the 45 days between any attack and subsequent replacement elections.  Congress therefore must pass a constitutional amendment that provides for the temporary appointment of Members of Congress. 

“I am encouraged that the Republican leaders have committed to continue this debate, and I hope that Congress will pass a constitutional amendment this year to finish fixing this problem.”
