Servicemembers risk their lives in support of the contingency operations that keep our nation safe. State courts should not be allowed to use a servicemember’s previous deployments or the possibility of future deployments when making child custody determinations.
Our Servicemen and women and should never be in the position of having to choose between their country and their family. We owe it to them to provide uniform legal standards regarding child custody.
Secretary Gates stated that he wants to work with Congress to pursue the creation of a federal uniform standard.
“I am convinced that the benefits outweigh the concerns, and thus
we should work with the Congress to pursue an acceptable legislative formulation.”

Proposal would protect custody rights during deployments
Legislation introduced in the House on Friday would protect child custody arrangements of deployed military service members.
The bill, introduced by Rep. Michael Turner (R-Ohio), would prohibit a judge from considering certain military deployments in determining the best interest of the child. Also, if custody were temporarily transferred to another person during a service member’s deployment, arrangements would return to pre-deployment status upon his or her return.
Gates Takes the Right Step toward Protecting Service Member Custody Rights
On February 15th, I received a letter from Secretary of Defense Robert Gates, in which the Secretary agreed with our fight for a Uniformed Standard of Protection for Service members in child custody disputes.

Protecting Child Custody Rights for Service Members Should be a Priority
The stories are too frequent: a service member, many times a single mom, is called to serve her country and is given a short time to wind down her personal business and deploy. She makes temporary custody arrangements for her children usually with her former spouse, sometimes in the form of a non-binding family care plan. The mom is then deployed. Upon return from deployment, she goes to pick up her child, and finds out that her ex-spouse won’t relinquish custody without a court order.
