The House received a communication from Michael M. Honda, Member of Congress. Pursuant to Rule VIII of the Rules of the House of Representatives, Honorable Michael M. Honda notified the House that he had been served with a subpoena issued by the Superior Court for Santa Clara County, California for documents in a civil case and that after consultation with the Office of General Counsel, he had determined that compliance with the subponea was consistent with the precedents and privileges of the House.

The Speaker laid before the House a message from the President transmitting a proclamation entitled "To Modify Duty-Free Treatment Under the Generalized System of Preferences, and for other purposes." - referred to the Committee on Ways and Means and ordered to be printed (H. Doc. 111-85).

7:15 P.M. -
The House received a message from the Clerk. Pursuant to the permission granted in Clause 2(h) of Rule II of the Rules of the U.S. House of Representatives, the Clerk transmitted a sealed envelope received from the White House on Thursday, December 24, 2009 at 1:41 p.m., containing a message from the President which transmitted a proclamation entitled "To Modify Duty-Free Treatment Under the Generalized System of Preferences, and for other purposes."

H.J. Res. 64:
making further continuing appropriations for fiscal year 2010, and for other purposes

7:14 P.M. -
Pursuant to a previous order of the House, consideration of the veto message on H.J. Res. 64 is postponed until the legislative day of January 13, 2010.

The Chair laid before the House the veto message from the President. (H. Doc. 111-84). In a Memorandum of Disapproval, the President stated the enactment of H.R. 3326 (Department of Defense Appropriations Act, 2010, P.L. 111-118), which was signed into law on December 19, 2009, has rendered the enactment of H.J. Res. 64 (Continuing Appropriations, FY 2010) unnecessary and accordingly, he is withholding his approval from the bill. In order to leave no doubt that the bill is being vetoed as unnecessary legislation, and in addition to withholding his signature, the President returned H.J. Res. 64 to the House along with the Memorandum of Disapproval.

The House received a message from the Clerk. Pursuant to the permission granted in Clause 2(h) of Rule II of the Rules of the U.S. House of Representatives, the Clerk transmitted a message received from the White House on Wednesday, December 30, 2009 at 1:20 p.m., containing the returned enrollment of H.J.Res. 64 and a memorandum of disapproval from the President.

7:12 P.M. -
Mr. Hoyer asked unanimous consent That if a veto message on H.J. Res. 64 is laid before the House on the legislative day of January 12, 2010, then after the message is read and the objections of the President are spread at large upon the Journal, further consideration of the veto message and the joint resolution shall be postponed until the legislative day of January 13, 2010, the House shall proceed to the constitutional question of reconsideration and dispose of such question without intervening motion. Agreed to without objection.

7:11 P.M. -
MORNING-HOUR BUSINESS - Mr. Hoyer asked unanimous consent that the order of the House of January 6, 2009, providing for Morning-Hour Debate be extended for the remainder of the 111th Congress, except that pursuant to H. Res. 1000, the date of May 17, 2010, shall be used in lieu of May 18, 2009. Agreed to without objection.
