The House received a communication from Daniel P. Beard, Chief Administrative Officer. Pursuant to Rule VIII of the Rules of the House of Representatives, Mr. Beard notified the House that he had been served with a civil subpoena issued by the Superior Court for the District of Columbia, for the production of documents, and that after consultation with the Office of General Counsel, he will make determinations required by Rule VIII.

ADJUSTMENT OF WHOLE NUMBER OF HOUSE - Under Clause 5(d) of Rule 20, the Chair announced to the House that, in light of the administration of the Oath of Office to the gentleman from Washington, Mr. Hastings; the gentleman from Illinois, Mr. Gutierrez; and the gentleman from Michigan, Mr. Rogers, the whole number of the House is adjusted to 433.

ADMINISTERING THE OATH OF OFFICE - Members-elect Gutierrez, Hastings (WA) and Rogers (MI) presented themselves in the well of the House to take the Oath of Office as administered by the Speaker of the House.

The House received a message from the Clerk. Pursuant to the permission granted in Clause 2(h) of Rule II of the Rules of the U.S. House of Representatives, the Clerk notified the House that she had received a message from the Secretary of the Senate on January 6, 2009, at 5:13 p.m. stating that that body had agreed to S.Res. 2, S.Con.Res. 1 and S.Con.Res. 2.
