H.AMDT.164 to H.R.2200 Amendment alters the standard for when TSA can issue an emergency regulation or security device without adhering to the rulemaking and public notice and comment provisions of the Administrative Procedures Act (APA). The amendment also allows TSA to issue a regulation or security directive when needed "to respond to an imminent threat of finite duration" and would require TSA to comply with the rule making requirements of the APA when a security directive or emergency order has been in place for more than 180 days.

9. H.AMDT.165 to H.R.2200 Amendment, as offered, requires TSA to establish protocols for identity verification of individuals who travel with known air traveler credentials. As modified, (text appears on page H6199 of the Congressional Record) the amendment provides for alternative screening procedures for individuals with top security clearances including random, risk-based screening determined to be necessary to respond to a specific threat to security.

H.AMDT.465 to H.R.3619 Amendment sought to require a GAO report on (1) the background checks and forms of identification required under state and local transportation security programs; (2) a determination of whether those requirements conflict with Federal programs; (3) a determination of whether those requirements assist in carrying out state and local government safety, security and law enforcement responsibilities; and (4) recommendations on ways to minimize redundant background checks and facilitate the sharing of data with state and local governments. Amendment also sought to prohibit the secretary of the Department which oversees the Coast Guard from preventing a state or local government from requiring a separate background check for entry into any area covered by a vessel or facility security plan.
