The amendment requires a rail carrier to transmit to the Secretary of Transportation a plan for providing notification to local emergency responders before transporting hazardous material through an area.  The plan must be updated annually with the Department of Transportation, and the Secretary of Transportation shall require that carriers periodically demonstrate that the procedures set forth in the plan are adequate to provide appropriate notice to local emergency responders.

The amendment requires rail carriers to notify appropriate first responders at least 12 hours before hazardous materials are transported through an area. The rail carrier must identify to the first responders the material transported and the appropriate rail carrier contact in the event of an accident.

(WITHDRAWN) This amendment would require the Secretary to consider (1) the impact of locomotive horn noise on a local community and (2) the unique characteristics of a community when reviewing applications for a waiver or exemption from sounding locomotive horns at highway-rail grade crossings.

The amendment strikes a provision in current law that allows States to adopt or continue in force an additional or more stringent rail safety or security law, regulation, or order when it is necessary to eliminate or reduce an essentially local safety or security hazard.

(REVISED) The amendment prohibits mechanical and brake inspections performed in Mexico of rail cars entering the United States from satisfying U.S. rail safety laws unless inspection standards, enforcement standards, worker training, and labor standards are certified to meet those of the United States. It prohibits hazardous material inspections performed in from satisfying applicable rail safety laws and regulations.

(REVISED) The amendment requires the Federal Railroad Safety Administration to issue regulations requiring owners of track carried on one or more railroad bridges to adopt safety practices to prevent the deterioration of railroad bridges and reduce the risk of human casualties, environmental damage, and disruption to the Nation’s transportation system that would result from a catastrophic bridge failure.  The amendment also strikes Sections 301, 610, and 616 of the reported bill because these sections were enacted in Public Law 110-53, the “Implementing Recommendations of the 9/11 Commission Act of 2007”.

The amendment allows state and local authorities to regulate solid waste management facilities.  This amendment would state that the Surface Transportation Board does not have exclusive authority to preempt state and local regulation of solid waste management facilities, as defined in the amendment.

The amendment prevents authorization of appropriations made by the bill that result in costs to the Federal Government from being effective except to the extent that the bill provides for offsetting decreases in spending of the Federal Government, such that the net effect of the bill does not either increase the Federal deficit or reduce the Federal surplus.

The amendment prohibits regulations which would impose a cost on any non-Federal entity from being issued under the bill unless the Secretary certifies that the requirements would materially and substantially benefit rail safety.

(REVISED)  This amendment authorizes funds to the Secretary to design and develop a pilot electric cargo conveyor system for the transportation of containers from ports to depots outside of urban areas.
