This report by the Congressional Budget Office (CBO) satisfies the requirements of section 202(e)(3) of the Congressional Budget and Impoundment Control Act of 1974, as amended. The report--required on or before January 15 of each year--is intended to assist the Congress in determining the authorizing legislation that should be in place before it considers the 13 regular appropriation bills for fiscal year 2006, which begins on October 1, 2005. On January 4, 2005, the House of Representatives created the Homeland Security Committee as a standing committee (see section 2(a) of H. Res. 5, 109th Congress). The committee was granted jurisdiction over homeland security policy; the organization and administration of the Department of Homeland Security; and many of the functions of the department, such as border, port, and transportation security. Also on January 4 (pursuant to S. Res. 445, 108th Congress), the Senate Committee on Governmental Affairs was renamed the Committee on Homeland Security and Governmental Affairs and was given jurisdiction over matters relating to the Department of Homeland Security (with several exceptions). However, because this report was in the final stages of production early in January 2005, the information presented does not reflect those recent changes in the committee structure. The entries in Appendixes A and B continue to reflect the committee structure and jurisdictions in place during the 108th Congress. That requirement is specified in the Balanced Budget and Emergency Deficit Control Act of 1985, which amended the Congressional Budget and Impoundment Control Act of 1974. According to the conference report on the Deficit Control Act, the purpose of that amendment was "to help Congress use the early months of the year to adopt authorizing legislation that must be in place before the thirteen regular appropriation bills can be considered."
The Role of AuthorizationsAuthorization laws are an outgrowth of the longstanding legislative practice of distinguishing between the laws that set forth federal policies and the laws that fund them. In general, authorization laws establish, continue, or modify federal programs. Funding for those programs is then provided separately in annual appropriation laws. Some authorization laws merge policy and funding actions--in effect, combining an authorization and appropriation in the same legislation. Such spending is referred to as direct, or mandatory, spending. There are two kinds of authorization laws. The first type is the "organic," or "enabling," statute, which makes broad grants of authority, establishes federal offices or duties, creates federal programs, or permits various activities to be carried out. The second type specifically authorizes the appropriation of funds either to carry out the various authorities or duties established under an organic statute or to achieve other purposes. (Such appropriation of funds may also appear in the enabling statute.) This report focuses on the second type of authorization law. In general, those laws are intended to offer guidance to the appropriations committees on the amount of program funding to be provided in annual appropriation bills. That guidance is typically expressed as an authorization of appropriations. Such authorizations are provided either for specific dollar amounts (definite authorizations) or for "such sums as are necessary" (indefinite authorizations). Authorizations of appropriations may be permanent, or they may cover only particular fiscal years. Authorizations that have a stated duration may be annual (pertaining to one fiscal year) or multiyear (pertaining to two, five, or any specific number of fiscal years). When such authorizations expire, the Congress may choose to extend the life of a program by reauthorizing the activity. The Congress may also extend a program simply by providing new appropriations for it. However, appropriations that are made available for a program after its authorization of appropriations has expired are considered "unauthorized." House and Senate rules--dating from the 19th century--generally preclude the Congress from considering appropriations that are not authorized by law. In both the House and the Senate, legislation containing unauthorized appropriations is subject to a point of order upon its consideration by either body.(1) However, House and Senate rules are not self-enforcing. An individual Representative or Senator must raise a point of order for the rules to be enforced. If no Member raises a point of order, an unauthorized appropriation may proceed through the legislative process. Although this report is intended to aid the Congress by identifying those authorizations of appropriations that have expired or will expire, it should not be considered definitive regarding the application of House or Senate rules. What constitutes an "unauthorized appropriation" under such rules is determined by the precedents within the House or Senate, and the applicability of those rules is determined by the respective Office of the Parliamentarian. More than half of all federal spending now goes to programs for which the authorizing legislation provides budget authority. Such direct spending includes funding for most major entitlement programs. (Some entitlements are funded in annual appropriation laws, but the amounts provided are controlled by the authorizing legislation that established the entitlements.) The authorization laws that provide direct spending are typically permanent, but some major direct-spending programs, such as the Food Stamp program and farm price and income support programs, require periodic renewal. In 2004, lawmakers renewed several major authorizations that had been under temporary extensions, including those for the Small Business Administration (through 2006), the flood insurance program (through 2008), and the Child Nutrition and the Special Supplemental Nutrition Program for Women, Infants and Children (through 2009). In addition, the Congress enacted laws that extended other authorizations through 2005, including those for higher education programs,
the Department of Defense and intelligence agencies, and the Coast Guard. Lawmakers also enacted temporary authorizations for Temporary Assistance for Needy Families (through March 31, 2005) and surface transportation programs (through May 31, 2005).
Listings of Unauthorized Appropriations and Expiring AuthorizationsThis report covers all appropriated programs that at one time had an explicit authorization of appropriations that has expired or will expire this year. Appendix A lists programs that have received a full-year appropriation for fiscal year 2005 but whose applicable authorization has expired. Appendix B lists programs whose authorization expires at or before the end of fiscal year 2005. The appendixes show the number and name of the public law containing the last authorization, the last year that the authorization was in effect, and the amount authorized in that year. If the authorization was for "such sums as are necessary," the report shows the amount authorized as "indefinite." In separate versions of this report, the listings of public laws in the appendixes are displayed in three ways--by House authorizing committee, by Senate authorizing committee, and by appropriations subcommittee (which follows the same structure in the House and Senate). The information in this report is drawn from CBO's Legislative Classification System, a database reflecting all public laws that contain nonpermanent authorizations of appropriations--up to and including laws enacted during the second session of the 108th Congress. In general, House and Senate rules require the appropriations committees, in their reports on general appropriation bills, to identify any programs that are funded in the bills but lack an authorization--including programs for which an explicit authorization of appropriations has never been enacted. This CBO report, in contrast, covers only programs that at one time had an explicit authorization that either has expired or will expire. Also, as mentioned earlier, many laws establish
programs with an authorization of appropriations that does not expire. Both the reports of the appropriations committees and this report exclude programs with that type of authorization because its effect is permanent.
Programs Funded in Fiscal Year 2005 with Expired Authorizations of AppropriationsAppendix A lists programs and activities funded by an appropriation for fiscal year 2005 whose authorization has expired. If the applicable 2005 appropriation law (or its legislative history) provides an explicit level of funding for the program, that amount is shown under "Unauthorized FY 2005 Appropriations." If no specific amount is provided (as in the case of a small program that is funded at an unidentified level in a large appropriation account or a program that is funded in several appropriation accounts), CBO determines whether the program is still being funded and, if so, the amount allocated for it. If that amount cannot be determined, the appendix notes that the specific dollar amount of unauthorized 2005 appropriations is not available. The Congress has appropriated about $170 billion for fiscal year 2005 for programs and activities whose authorizations of appropriations have expired (see Tables 1, 2, and 3). That amount is about $80 billion higher than reported by CBO for 2002.(2) The difference results mostly from certain large authorizations of appropriations that expired in 2003 and 2004, including authorizations in the 21st Century Department of Justice Appropriations Authorization Act (with 2005 appropriations of about $22 billion), the Quality Housing and Work Responsibility Act of 1998 ($20 billion), and the Foreign Relations Authorization Act for Fiscal Year 2003 ($15 billion), as well as authorizations for Head Start ($7 billion), the Centers for Disease Control ($4 billion), and the Low Income Home Energy Assistance Program ($2 billion). The largest single unauthorized appropriation for 2005 is for veterans' medical care ($27.9 billion); the appropriation was last authorized for 1998.(3) Other sizable programs with expired authorizations of appropriations include the Section 8 tenant-based housing assistance program (which was last authorized for 2003 and has funding for 2005 of $14.9 billion); the National Aeronautics and Space Administration (last authorized for 2002 and funded in 2005 at $14.6 billion); and certain programs of the National Institutes of Health (last authorized in 1996 and funded in 2005 at $12.1 billion). Authorizations of Appropriations That Expire on or Before September 30, 2005Appendix B lists programs and activities with an authorization of appropriations that expires by the end of fiscal year 2005. The appendix indicates the amounts authorized to be appropriated in 2005 for expiring programs and activities, not the amounts actually appropriated for that year. Definite authorizations contained in laws under the jurisdiction of House and Senate authorizing committees that will expire by the end of this fiscal year total about $526 billion (see Tables 4, 5, and 6). Most of that amount (about $446 billion) is authorized in a single law, the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (Public Law 108-375), which also includes an authorization for funding for activities in Iraq and Afghanistan. Typically, authorizations for defense funding are renewed annually. Another annual reauthorization is the Intelligence Authorization Act for Fiscal Year 2005. Most of the authorizations for intelligence activities are classified. Other major definite authorizations that expire by the end of 2005 include the Victims of Trafficking and Violence Protection Act of 2000 and 2003 (P.L. 106-386, P.L. 108-193); the National Historic Preservation Act Amendments of 2000 (P.L. 106-208); the Help America Vote Act of 2002 (P.L. 107-252); and the Estuaries and Clean Waters Act of 2000 (P.L. 106-457). Thus, as in recent years, the total amount of expiring definite authorizations of appropriations this year is concentrated in a handful of laws. Of the 66 laws with authorizations that expire this year, four account for nearly 95 percent of the year's expiring definite authorizations. Conversely, 29 laws have definite authorizations of $50 million or less; together, they make up less than 0.1 percent of the total amount of expiring definite authorizations. Some laws with expiring indefinite authorizations also involve relatively large amounts of funding. Indefinite authorizations that expire this year include the Millennium Challenge Fund (authorized in the Omnibus Consolidated Appropriations Act of 2004, P.L. 108-199); the Project Bioshield Act of 2004 (P.L. 108-276); the Older Americans Act Amendments of 2000 (P.L. 106-501); and programs funded in the Children's Health Act of 2000 (P.L. 106-310).
