THE ``DEPARTMENT OF HOMELAND SECURITY APPROPRIATIONS ACT, 2010''

Committee on Rules: Granted by a non-record vote, a structured rule providing for consideration of H.R. 2892, the Department of Homeland Security Appropriations Act, 2010. The rule provides one hour of general debate equally divided and controlled by the chair and ranking minority member of the Committee on Appropriations. The rule waives all points of order against consideration of the bill except for clauses 9 and 10 of rule XXI. The rule waives all points of order against provisions in the bill for failure to comply with clause 2 or 5 of rule XXI. The rule makes in order the following amendments: (1) the amendment printed in part A of the Rules Committee report; (2) the amendments printed in part B of the report; (3) not to exceed four of the amendments printed in part C of the report, if offered by Representative Flake of Arizona or his designee; and (4) not to exceed one of the amendments printed in part D of the report, if offered by Representative Campbell of California or his designee. The rule provides that each such amendment shall be considered as read, shall be debatable for 10 minutes equally divided and controlled by the proponent and an opponent, and shall not be subject to a demand for division of the question in the House or in the Committee of the Whole. All points of order against such amendments are waived except those arising under clause 9 or 10 of rule XXI. The rule also provides that the amendments printed in part B, C, or D of the report may be offered only at the appropriate point in the reading. The rule provides that for those amendments reported from the Committee of the Whole, the question of their adoption shall be put to the House en gros and without intervening demand for division of the question. The rule provides one motion to recommit with or without instructions. The rule provides that after consideration of the bill for amendment, the chair and ranking minority member of the Committee on Appropriations or their designees each may offer one pro forma amendment to the bill for the purpose of debate, which shall be controlled by the proponent. The rule provides that the Chair may entertain a motion that the Committee rise only if offered by the chair of the Committee on Appropriations or his designee and that the Chair may not entertain a motion to strike out the enacting words of the bill (as described in clause 9 of rule XVIII). Finally, the rule provides that during consideration of H.R. 2892, the Chair may reduce to two minutes the minimum time for electronic voting under clause 6 of rule XVIII and clauses 8 and 9 of rule XX. The rule considers as an original bill for the purpose of amendment in the nature of a substitute recommended by the Committee on Armed Services. The committee amendment shall be considered as read. The rule waives all points of order against the committee amendment except those arising under clause 10 of rule XXI. The rule makes in order those amendments printed in the report of the Committee on Rules and amendments en bloc. The amendments made in order may be offered only in the order printed in the Rules Committee report except that the amendments may be offered out of order provided the chair of the Committee on Armed Services announces from the floor a request to that effect, may be offered only by a Member designated in the report, shall be considered as read, shall be debatable for the time specified in the report equally divided and controlled by the proponent and an opponent, shall not be subject to amendment, and shall not be subject to a demand for a division of the question in the House or in the Committee of the Whole. The rule also permits the chair of the Committee on Armed Services or his designee to offer amendments en bloc if those amendments have been printed in the Rules Committee report and not earlier disposed of. The Chair of the Committee of the Whole may recognize for consideration any amendment printed in the report out of the order printed but not sooner than 30 minutes after the chair of the Committee on Armed Services announces from the floor a request D750to that effect. Proponents of amendments to be considered en bloc may submitted a statement in the Congressional Record immediately prior to the disposition of the amendments en bloc.
