Small Business

At a time when the U.S. economy is struggling, it is more important than ever for small businesses to have the support they need. I was a small businessman back in Lubbock for many years before coming to Congress, and so I understand the needs and concerns of the small business community. According to 2004 data, the small business sector represents more than 99 percent of all employers, employing 51 percent of private-sector workers. Additionally, there are about 25.4 million non-farm small businesses in the U.S.

I have been working on several pieces of legislation that will address some of the hardships small business face.  This year I have introduced H.R. 456, the Small Business Paperwork Relief Act.  This legislation would prevent excessive fines on small businesses for first-time, inadvertent paperwork violations.  Due to the sheer volume and complexity of federal regulations, even the most diligent small business-owner may inadvertently make an error or miss deadlines associated with government paperwork.  This legislation would give them time to correct the mistake before facing a penalty.

In addition, I continue to co-sponsor legislation that would small businesses to join together to offer health insurance to their employees through Association Health Plans.  Many employers want to offer health benefits to their employees, and this legislation would make it more affordable for them to do so.

I’ve also co-sponsored bills that would permanently repeal the Estate Tax and that would reduce the harm caused by frivolous lawsuits.  It is simply wrong that the federal government can take over half the value of a family’s small business simply because the owner passes away.  Due to tax relief enacted in 2001, the “death tax” will be eliminated in 2010.  However, if the tax relief is not extended, this tax will come back in full in 201l.  It is imperative that Congress permanently end the Estate Tax so families are not forced to sell their small business simply to pay the federal government.
