"Historic Failure" to Pass Appropriations Bills

Not once since before the 1950s has Congress failed to pass a single appropriations bill by the August recess. Even with outstanding veto threats in 2000 and 1992 – final years of the Clinton and Bush Administrations, respectively – the House and Senate still managed to pass the majority of their appropriations bills and have them signed into law.

This kind of epic failure by Congress is a once in a lifetime event. Senator Appropriations Ranking Republican Senator Thad Cochran and I agree that this is not only an irresponsible way to run government, but will have a catastrophic effect on federal programs and the people they serve across the country.

The Democrats’ failure to pass these funding bills will force critical programs and projects - such as new housing assistance for returning veterans, 2000 new border security agents, and new grant funding for local police and fire departments - to go unfunded this year. What will happen to these programs in the future remains ambiguous.

Moreover, halting the Appropriations process means that critical provisions to lower gas prices – such as lifting the moratorium on energy exploration in the outer continental shelf or removing language that restricts domestic oil shale development – will not receive an up or down vote, nor even be considered by either Committee.

American families don’t have the option of putting off their bills until next year, so why should Congress? Once again, the Democrat majority has put politics above people, and it has resulted in one of the largest legislative failures in a century.

Disappointment in the Democrats’ plan to abolish the Medicare trigger

It’s been said too many times without being heard; Medicare, one of our country’s largest entitlement program, is quickly dying.  It is wrong that Democrats would propose a bill to eliminate the warning system designed to keep this program afloat.  You wouldn’t take the batteries out of your smoke detector, so why would you eliminate the warning system on a massive government program that our seniors depend on?  This is irresponsible and incredibly reckless legislation that will hurt our seniors and leave Medicare in shambles.

Reaction to House Passage of Latest Housing Plan

I don’t think either side is thrilled with the final housing compromise we passed today, although that’s not always a bad thing.  The good news is that the plan includes the three pillars of housing reform that I have been promoting for years – increased housing counseling, FHA reform, and an improved GSE regulator.  Taken together, these three portions of the bill promise to have a positive, stabilizing effect on the market without squandering taxpayer dollars.

American Energy Act

Americans across the nation are reeling from sky high energy prices, and the majority’s irresponsible inaction only exacerbates the situation. Common sense tells us that we must have an ‘all-of-the-above’ energy plan, yet all we have seen is a ‘none-of-the-above’ attitude from the Democrat leadership in Congress. Action on energy is long overdue, and this bill is targeted to provide relief by increasing the supply of American-made energy, improving conservation and efficiency, and promoting renewable and alternative energy technologies.

UN Peacekeepers Paying Homage to Hezbollah Dead is Disturbing

Photographs showing United Nations Interim Force in Lebanon (UNIFIL) troops saluting the remains of dead Hezbollah militants are deeply disturbing and, frankly, quite repugnant. UN authorities have defended the soldiers’ actions, saying that the troops were following custom.

Rather than denying UNIFIL’s failings and justifying its soldiers’ reverence for dead extremists, perhaps UN authorities should remind troops on the ground that their principal job is to enforce UN mandated ceasefires objectively. Allowing Hezbollah militants to rearm, leaking them information, and saluting their dead does little to keep the peace or restore faith in a broken UN system.

The behavior of UNIFIL troops has again demonstrated the tragic failings of discipline that continue to plague UN peacekeeping missions. UN officials need to clamp down now on malfeasance and make good on their promises of reform.

America Needs a Balanced Energy Portfolio

This past weekend, my colleagues and I were able to meet with scientists and engineers who are working on the next generation of technology for energy derived from solar, wind, hydrogen, biomass and fuel cells representing the future of American energy.

On the North Slope of Alaska, we discussed both current and emerging oil and gas production technologies which hold tremendous promise not just for America, but around the world.

Simply put, we need a balanced energy portfolio with every source of American energy on the table – an ‘all of the above’ approach.  This is the only way to reduce our nation’s dependence on foreign sources of energy – something tremendously important for our economic and national security.

People are hurting all over our country as the national gas price continues to increase, and is now over $4 a gallon. The increase in gas prices has caused a rise in the price of groceries, transportation, and consumer goods, everything that Americans depend on to live their lives. I haven’t talked to one constituent that is not feeling the financial pressure – in some cases, people are losing 1/3rd of their paychecks to pay for gasoline.

While it may seem the effects of high gas prices are not getting attention in Congress, rest assured it is echoing loudly through some of the House and Senate offices and we are listening. People have asked for a solution and we see now how truly important it is for our nation to become energy independent. I firmly believe the only way we can truly achieve this goal is to take a good hard look at the resources available to us here at home to solve the problem of high gas prices.

Congress needs to look at both short-term and long-term solutions for our gas price problem. We should encourage and incentivize, not mandate, the development of alternative energy sources to lessen our dependence on foreign sources of energy for the long term. In the meantime, we need to utilize accessible resources we have here at home to bridge us to long-term solutions. That’s why I worked with Congressman Buyer, and other Members, to introduce H.R. 6001- The Main Street U.S.A. Energy Act of 2008. This legislation takes a commonsense approach to the energy emergency facing our nation and recognizes that energy security and energy independence go hand in hand. H.R. 6001 enables American industries and resources to take good care of the American people and bring about long-term solutions.

While we continue groundbreaking research into alternate energy forms, we must have access to the numerous domestic energy supplies, such as oil and natural gas, to get us to long-term solutions. The United States Minerals Management Service (MMS) calculated that there are large amounts of undiscovered technically recoverable federal resources in and around our country. Congress must open up these sources, not only to increase our supply, but to make our country safer by being less dependent on foreign energy resources.

Recently, President Bush and Senator McCain both suggested that we should allow states the right to permit deep sea exploration for oil and gas by lifting the federal moratorium on offshore drilling, opening up the Outer Continental Shelf (OCS). They share a position I have held for years. According to the MMS, nearly 85 percent of the lower 48 OCS energy resources remain restricted from domestic exploration. The MMS also found that out of the United States’ 1.76 billion acre OCS, only a mere three percent is leased for oil and gas exploration and development. The United States is the only developed nation in the world that forbids safe energy production on its OCS.

We can look to our northern neighbor, Canada, as an example of successful use of domestic resources for fuel. Canada has become the world's largest producer of tar sands, or bitumen, an unconventional fuel source similar to oil shale. They have successfully converted the source into crude oil which may be used to produce diesel and jet fuel. As a side note - there is estimated to be more than two trillion barrels of recoverable oil shale in the United States.

Also, according to MMS, there is roughly 633 trillion cubic feet of natural gas resources and 115 billion barrels of U.S. crude oil resources available beneath federal lands and coastal waters. For perspective on these numbers- the world has used one trillion barrels of oil since the first oil well was successfully drilled in Pennsylvania almost 250 years ago. The supply of natural gas could heat approximately 60 million homes for 160 years and the oil supply could power over 60 million cars for 60 years, yet, most of these resources are off-limits to development. The Bureau of Land Management found that only eight percent of onshore oil (not including oil shale) and 10 percent of onshore natural gas are accessible under standard leasing terms.

American citizens are calling on Congress to lower gas prices. As Members of Congress, it is our responsibility to lead and to respond effectively. I believe there is no good explanation why the federal government would not give our states the right to use the resources they have to help our nation become energy independent. Congress could give states the power to decide whether or not to explore within 100 miles of their shoreline, and states could set their own restrictions for exploration while also sharing in the revenues.

The answer is a comprehensive approach, finding actual short-term and long-term solutions using our resources here at home. We need to access what we have on and beneath our soil to become energy independent and less reliant on foreign countries that now supply our energy. Domestic exploration will release our nation from the continuous burden of high gas prices and bridge us to long-term energy solutions.

House Democrats Waste More Time with No-Energy Legislation

Having begun to realize that they are way behind the American people on the need for more drilling onshore and off-shore, House Democrats thought that simply the appearance of having changed their tune on drilling would be enough.  But the American people know that political maneuvers like today’s legislation do not do a thing to lower energy prices.  In fact, with gas prices well over four dollars per gallon, the American people are literally paying the bill for this Democrat Congress’ failure to take up an all-of-the-above energy policy.

Reduce Boutique Fuels, Reduce the Price of Gasoline

While Congress further takes up the debate on offshore drilling and continues to speculate on the role of speculators, there are things we can do now to improve the efficiency and effectiveness of our nation’s energy infrastructure. “Boutique fuels” are so named because they are specialty blends which seek to mitigate poor air quality standards in certain areas. While the Clean Air Act specifically requires certain areas to utilize federal reformulated gasoline (RFG) in order to reduce emissions and improve air quality, in some cases states are able to create their own standards in order to meet air quality goals.

CHEESEBURGERS AND FUEL STANDARDS

The current system of gasoline standards in the U.S. is complex.  Because of numerous state and federal standards, suppliers of gasoline face many different criteria for fuel quality, resulting in many different types of fuels.  These bureaucratic requirements lead to situations where adjacent or nearby areas may have significantly different standards.  These different fuel formulations are referred to as “boutique fuels.”

The Fight for Energy: Those Who “Protect” The Environment vs. Those Who Depend On It.

It is a great honor to represent the scenic stretch of Tennessee from Clarksville to Nashville, to Memphis. Anchored by Tennessee’s great metropolitan centers, the heart of my district is the rural engine of Tennessee’s economy and home to the men and women who work the land every day. These are the true environmentalists and conservationists, those for whom clean air and clean water isn’t an abstract notion, but the vital force that keeps the corn, cotton and soybeans growing. They are among the hardest hit by escalating energy prices.

Contrast them with the other “environmentalists”. These are the latte’ sipping earth-first-istas who believe corn is more appropriately poured into a gas tank than into corn meal muffins. Their environmental experience is a drive through the Napa Valley. “Pay more, drive less” is an option for them because they don’t have to depend on hauling goods to market to make their living. After all those spinning classes, they think nothing of a brisk bike ride to the office.

My constituents and I live a very different lifestyle. While the trial lawyers and green peacers sip proseca and chat politely about the fate of the ridge crested woodchuck; my constituents pile their kids into the mini-van and head to church, summer camp, swimming lessons, and baseball practice. They don’t want the liberal elites to make it more expensive to dream big dreams and turn those dreams into reality.

For my constituents, pay more and drive less isn’t an option. Perhaps the family budget in rural Tennessee can’t absorb the spike in gas prices as easily as the family budget in San Francisco. There isn’t a commuter train that connects Waynesboro to Clifton, nor is there a subway system to whisk passengers from one end of Memphis to the other.

What my constituents need is innovation for short term, mid-range, and long term American energy solutions. They need credit for energy efficiency and conservation where they can achieve it; a clear path to American self sufficiency in the long run; and a menu of reasonable, workable energy solutions as soon as possible.

The answer they get from Washington however is “no”. No to the new nuclear power needed to charge electric vehicles; no to the new clean coal technologies that enable coal to liquid fuels that that would help America become energy independent and burn cleaner than petroleum; and no to tapping the untouched oil resources right here in the United States.

They hear plenty about wind, solar, and biomass, but until they can drive their crops to market in a solar powered semi or start their tractors with bio-fuel that functions in extreme temperatures, they need more immediate solutions.

Maybe it is time for those that are a roadblock to action on the energy issue to let us know what they are for. Are they for higher prices? Are they for driving less and paying more? Do they want to see us on bicycles and walking the five miles to the office? What we do know is that they stand as the lone roadblock to reasonable American energy solutions.

Administration Action on Deepwater Energy Exploration

In one loud voice, the American people are demanding responsible development of our own deepwater national resources.  It is encouraging that the White House has recognized this and done its part to allow increased access to American-made energy.  This essential action leaves only Speaker Pelosi and her leadership in Congress standing in the way.  To meet the administration’s commitment for more American-made energy, Speaker Pelosi must now allow a vote so we may answer the deafening pleas of the American people.  Though this Democrat majority has repeatedly spurned the idea of accessing deepwater energy sources, I am hopeful they will recognize the imperative of action and allow a responsible vote this week.

Promoting New Technology to Reduce Energy Consumption

As co-chair of the House Renewable Energy and Energy Efficiency Caucus, I, along with Congresswoman Zoe Lofgren (D-Calif.), introduced legislation yesterday to authorize the House of Representatives to carry out a series of demonstration projects that would promote the use of new and innovative technology to reduce energy consumption, promote energy efficiency and trim costs in House operations. The bill authorizes five million dollars in Fiscal Years 2009 and 2010 for these projects and requires that the Chief Administrative Officer of the House submit a report detailing the projects and its results.

Now that gas prices have increased to more than $4.00 a gallon, Congressional Democrats are finally realizing that the basic economic principle of supply and demand is real. World demand for oil is growing, while supply has remained fairly level, causing the price to skyrocket. Ironically, in response the majority party in our own Congress is asking other countries to increase supply while opposing such increases at home. But there’s another way: It’s time to let American companies produce American energy for American consumers.

Congressmen Should Sign Petition to Increase Oil Supply

Hundreds of thousands of Americans have signed petitions calling on Congress to increase U.S. oil supply to bring down prices. When constituents started calling me to say they had signed, I wanted a way for all Americans to know where their member of Congress stands on this issue. I created a ‘no-wiggle-room pledge’ that reads ‘I will vote to increase to U.S. oil production to lower gas prices for Americans.’ It’s simple and it gets to the heart of the real solution. Yes, we need to conserve; yes, we need to develop alternative energy sources. But right now, we still need traditional energy and I want to put members of the House on record: Are you for helping American businesses and American families with their energy costs or not?

More than 65 percent of Americans support more traditional energy exploration in this country. I’m saying: Explore offshore, open up U.S. lands and build more refineries. I encourage people all over this country will call their member of the House and encourage them to sign the Westmoreland petition to increase oil production. The petition is on the floor of the House during votes. Every congressional district is listed and we update our web site, www.house.gov/westmoreland regularly with everyone who has signed it.

BILL IS FOCUS OF REPUBLICAN ENERGY ACTION

I joined with Congressman Rick Boucher (D, Virginia-9) in 2006 to introduce our first bill promoting coal-to-liquid technology in the production of fuel. Last year we introduced the Coal Liquid Fuel Act (HR 2208), which would authorize the Secretary of Energy to enter loan agreements for plants of this nature.

We have as much energy in BTUs in the Illinois coal basin as Saudi Arabia and Kuwait have in oil. Our nation must start to use our own natural resources if we are to make a dent in the ever-rising prices of oil and gas.

Congressman Peter Roskam (Illinois-6) has introduced a discharge petition on HR 2208 as part of Republican efforts to force floor votes on important energy legislation. The discharge petition would need 218 Members of the House to sign in order to force a vote on the bill.

We are not having votes in the House on legislation that deals with the most pressing issue people care about, which is high gas prices. And when winter gets here, natural gas heating bills will be sky high too.

Discharge petitions are one of the few ways Republicans can pressure the Democrats in the majority to bring these bills to the floor for votes.

I have already signed discharge petitions on the No More Excuses Energy Act (HR 3089), which would increase domestic production of oil and natural gas; HR 2270, which would allow refineries to be built on closed military bases; and HR 5656, which would allow the government to purchase alternative fuels, such as coal-to-liquid.

I have also signed a petition that promises, "I will vote to increase U.S. oil production to lower gas prices for Americans." Believe it or not, but some Members of Congress refuse to sign such a pledge.

Bipartisan Supplemental Legislation

I praise the bipartisan efforts that enabled a supplemental spending bill to be passed by the U.S. House of Representatives that includes funding for disaster relief in the wake of massive flooding in the Midwest.

This legislation funds the Global War on Terror, increased veterans' education benefits,extended unemployment payments, as well as disaster relief -- and importantly does it without a tax increase," Shimkus said. "Many of my constituents and others throughout the region are facing devastating floods. This quick response will help alleviate the damage.

A total of $2.65 billion is allocated for natural disaster relief and recovery from flooding as well as recent tornadoes in the Midwest. The U.S. Department of Agriculture’s emergency conservation and watershed protection programs will receive $479.9 million; $606 million will be for Army Corps of Engineers natural disaster response projects; $266.8 million for Small Business Administration disaster loans; $897 million for FEMA disaster relief; $300 million for Community Development Block Grants; and $100 million for the Economic Development Administration.

Educational benefits for all members of the military who have served on active duty since September 11, 2001, will be increased," Shimkus noted. "And we have listened to our veterans who have asked that these benefits be made transferable to the spouse or child of a service member."

All states will qualify for at least a 13-week extension of unemployment insurance under the bill. Another 13 weeks of unemployment insurance would be provided to states with high unemployment rates.

Republicans succeeded in preventing a tax increase Democrats had proposed to offset costs of the legislation, which still must pass the Senate before it can go to President George W. Bush for his signature.

Upholding Individual Right to Bear Arms

Today’s decision by the Supreme Court is an historic victory for America.  Our founders knew that there were certain fundamental inalienable rights, including the right to keep and bear firearms, and pointedly wrote that into the Second Amendment to our Constitution.  Washington, D.C. does not have the right to unilaterally dismiss the Constitutional rights of law-abiding Americans, and today’s decision affirmed that view.  As someone who has fought for Second Amendment rights in Congress, and who holds a concealed carry permit back home in Florida, I can’t tell you how happy I am that the Supreme Court has adhered to the intent of our founding fathers and upheld the right of all law-abiding Americans to keep and bear arms.

Dems get out of town without taking care of business

Democrats have decided to get out of town early yesterday without passing a single energy bill that would lower prices at the pump.  This isn’t what the American people elected us to do and I assure you, as families prepare for the 4th of July weekend, they will look to Congress to provide relief at the pump.  The truth is that the only way to lower gas prices is to explore for new American energy in an environmentally safe way as well as increase our conservation.  Voting on misleading or inaccurate bills that do nothing to solve the real problem only sends the wrong message to American families.

Republicans call 3.2 million Americans to talk energy

In a major collaborative effort to speak with millions of constituents regarding skyrocketing gas prices, House Republicans called some 3.2 million households throughout the country during the last two weeks in June.  The effort was in response to surging gas prices and the direct affect they have on American families.  These tele-town hall events allowed constituents to participate in “live” interactive question-and-answer sessions over the phone with Republican officials.

Fighting Against Rising Food Costs

Today, I condemn the Democrats’ massive farm bill which would increase our nation’s already rising food costs. The bill would impose a new requirement that at least 85 percent of U.S. sugar consumption must come from domestic producers. Furthermore, the bill would create a new sugar-to-ethanol program. This program would require the purchase of “surplus” sugar for sale to ethanol producers to turn into biofuels. Both provisions are designed to wall off consumers from the benefits of a drop in sugar prices as the U.S. continues to liberalize its sugar trade laws, costing consumers an estimated additional $400 million per year.

Rising fuel costs are bearing down on our nation’s economy and are hampering economic recovery. The more money people have to spend on gasoline, the less they have to spend on other goods or services.

Call For Answers Regarding Bear Stearns Bailout

As a member of the House Financial Services Committee, I called for answers from Federal Reserve Chairman Ben Bernanke and Treasury Secretary Hank Paulson regarding the recent bailout of Bear Stearns. With the support of 23 Members, I sent a letter to Bernanke and Paulson asking for answers to a series of specific questions involving the Fed’s actions. I have already asked Financial Services Committee Chairman Barney Frank to hold a Congressional hearing about this issue but Chairman Frank has yet to respond.

Today I attended a ceremony at the White House honoring Pope Benedict XVI. It was a blessing to be a part of the momentous occasion of Pope Benedict's visit to the White House. Like his predecessor, the Holy Father has struck a chord with the American people by serving as a humble servant of God, who is full of timeless wisdom. Pope Benedict reminded us how, during our earthly journey, we are compelled to promote the liberty and dignity of our fellow human beings. His message of renewal and hope touches people of all faiths and has a heartening effect for all humanity throughout our turbulent times. The Holy Father eloquently expressed the moral duty of public officials to serve the least of our brothers and sisters through a humane dialogue Founded upon faith and reason, the first principles upon which our free republic was founded. People of all faiths should pray for the Holy Father; embrace his message of renewal and hope; and wish him a happy birthday.

President Bush Must Skip Communist Olympics

It’s all the rage to say, “Our GOP has lost its way.”  It’s quite beyond dispute, for the truth remains the truth.    Yet the stock recitation of selected symptoms -- spending, Iraq, Katrina, etc… -- omits a sinister affliction consuming the heirs of Lincoln and Reagan.  The ravenous malady eclipsing our honor is this: Republicans coddle communist China.   No starker episode exhibits our anile need for a moral hospice before we slither into the dust bin of history than the one playing out before Americans’ astonished eyes.  Legacy building with the urgency of a dying Pharaoh staring at an unfinished Sphinx, George Walker Bush is bent upon being the first U.S. President to attend a foreign nation’s Olympics.  The nation in question is communist China, the shock troops of which are presently bludgeoning Tibetan Monks as if they were orange bathrobed baby seals.  (One shudders at the prospect this Tibetan repression is the Chi-coms’ sedulous sally into Olympic demonstration sports.)   Notwithstanding the Global Generation’s remaining misanthropes’ unsophisticated quibbling (i.e., me and mine), our Compassionate Conservative-in-Chief has eagerly RSVP’ed to the communist dictatorship’s dramatic recreation of the Berlin Olympics.  Given “The Decider’s” resolve, hope dims we might disabuse his whimsy that watching a wobbling discus with the wanton butchers of Tiananmen Square can advance the sacred cause of human freedom.  But we are duty-bound to the endeavor, lest as “history with its flickering lamp stumbles along the trail of the past” she finds us fallen from the ranks of honor.   Perhaps we could appeal to our President’s historical sensibilities by reminding the Leader of the Free World that attending this evil regime’s games will forever stain his legacy by depicting him as calloused to the subjugation of Tibet and sundry other communist abominations.  Really, how would this generation of Americans esteem Franklin Roosevelt -- no slouch at setting Presidential precedents -- had he not let the cup of the Berlin Olympics pass from his nicotine stained lips and, instead, pursed them into a smirk with Der Fuerher for Leni Riefenstahl’s lens.   Yes, this assumes Mr. Bush worries he may one day be regarded by posterity in the manner William Manchester recalled a discredited generation of sophisticated British “statesmen”, save one: “And as (Churchill’s) debts mounted and his gloom deepened, England’s indebtedness to Stanley Baldwin rose…in his final deed for the homeland, he joined Chamberlain in telling Tory MPs that if they felt they must deplore totalitarianism and aggression, they must not name names.  It was important, he said, to avoid ‘the danger of referring directly to Germany at a time when we are trying to get on terms with that country.’  Fleet Street cheered.  So did Britain.  These were men of peace.”    In fairness, they were also the jackasses who paved a second road to Hell.   If such an appeal to history’s verdict proves fruitless, we could remind our Commander-in-Chief communist China is:   Arming our enemies;
Engaging in espionage against us, including the use of cyber warfare;
Subjugating Tibet;
Abetting genocide in the Sudan;
Compelling a “One Child Policy” and forcing abortions amongst its people;
Committing predatory trade practices against us;
Denying their people’s God-given human rights;
Subverting sovereign democracies;
Supporting their fellow dictatorships;  and, generally,
Being an unsporting bastion of tyranny. 

Could this partial recounting of the rogue regime’s transgressions against our nation and others prove to the President that attending the communist Chinese Olympics will subvert the moral authority of his position as the Leader of the Free World -- a Free World which, along with the world’s oppressed, will be watching and weighing his participation?   Could this enumeration of grievances against the Chi-coms help the Chief Executive glean that the President of the United States cannot attend these games as a passive spectator?  (This is, after all, why the Chi-coms invited him.)   Could such a factual exposition convince Mr. Bush that attending their Olympics will reinforce our foreign policy “experts’” suicidal communist China “exception” and, in the event, make President Bush’s political statement thus:  “The United States is devoted to the self-evident truth every human being is endowed by their creator with the unalienable right to life, liberty, and the pursuit of happiness -- except in communist China”?   Given these right reasons, would the President reconsider, for the sake of our free republic’s sovereign citizens; and for the sake all the world’s enslaved and oppressed who, yearning to breathe free, believe our nation remains their beacon of liberty and bastion of hope?   Thus ends our lesson in rhetorical questions.   Ever the political masochist, I once circulated a “Dear Colleague” letter to President Bush positing much of the above and requesting he not attend communist China’s Olympics.  Only a handful of brave souls signed my entreaty; undaunted, in September 2007 the missive flew.  Certain I had affixed the correct address of Mr. Bush’s taxpayer-subsidized housing, I am saddened to report he has not replied to this Congressional correspondence with the alacrity he did the Chi-coms’ Olympic invite.   As the Year of the Rat scurries toward the opening ceremonies, however, I and my anti-communist ilk have not been idle.  On April 1, I introduced H.R. 5668, which would bar any United States government official from attending the Beijing games’ ceremonies.  (Importantly, this legislation does not impact our athletes.)  Oh, I know H.R. 5668 requires the President’s signature or a Congressional over-ride of his veto to become law.  Still, while it may not persuade the President to be “unavoidably otherwise occupied elsewhere in the world” during the communist Chinese Olympics, it will meet our moral imperative to our posterity, our country, and the cruel muse of History:   For when, once again, history’s flickering lamp illumes our aged cheeks and strews her lengthening shadows across our fleeting existence, she will avow how the supporters of H.R. 5668 did “march always in the ranks of honor.”   Pray she finds Republicans amongst them.

Reps. Fossella & Pascrell Unveil Bipartisan Homebuyers Tax Credit Bill

The housing crisis is at the heart of the economic slowdown that confronts our nation today. That is why Congressman Bill Pascrell (D-NJ8) and I unveiled bipartisan legislation to provide a temporary homebuyers tax credit of $10,000 in an effort to boost the housing market and spur economic growth.   A homebuyers tax credit would provide an immediate boost to restore the housing market while stabilizing prices and reducing foreclosures. In many communities, housing inventories continue to increase as home prices continue to decline – a recipe for long-term economic trouble unless we act to encourage homeownership. This bill represents a piece of the puzzle to solving the housing crisis. It will also help Americans protect the equity that they have worked so hard to build up over the years.   The legislation would apply to principle residence purchases to protect against speculative purchases, “flipping” or abuse and could be claimed only once by taxpayers. The measure, which is targeted at modest home purchases but acknowledges high-cost areas, would apply only to houses that meet the new GSE conforming loan limits passed in the Economic Stimulus Package – 125f median home price, not to exceed $729,750. In addition, the bill includes an Alternative Minimum Tax (AMT) blocker to protect Americans who claim the credit. The tax credit would expire one year after enactment. A tax credit is a dollar-for-dollar reduction in an individual’s tax liability. For example, a taxpayer with a liability of $15,000 and a tax credit of $10,000 would be required to pay $5,000 in taxes.   This legislation is needed now more than ever because nationwide, seasonally-adjusted home sales decreased from 6.6 million in February 2007 to 5 million in February 2008 -- a decline of nearly 24Home sales have dropped from nearly 7.1 million in 2005 to 6.48 million in 2006 (a decline of 8 Our bill is loosely modeled after the successful mid-1970s tax credit for home purchases, which is credited with reducing a record-high three-year supply of unsold houses, increasing production and boosting housing prices.

During a hearing held by the Committee on Foreign Affairs Subcommittee on the Middle East and South Asia entitled “Strategic Chaos and Taliban Resurgence in Afghanistan,” I made the following remarks.  The main witness at today’s hearing was Retired Lieutenant General David Barno, Director of Near East South Asia Center for Strategic Studies at the National Defense University (NDU).  Before joining NDU, General Barno took part in Operation Iraqi Freedom and Operation Enduring Freedom.  He has served as Commanding General, United States Army Training Center and Fort Jackson.  “Thank you, Chairman Ackerman for holding this hearing on Afghanistan and our mission there.  “Let me begin, by saying I am forever proud of the hard work and dedication of our military men and women who are serving in Afghanistan.  Over my six visits to Afghanistan to visit with our troops– including four quarterly visits with members of the 218th Brigade Combat Team, my former unitof 28 years, led by Brigadier General Bob Livingston – I have seen how they have answered the call of their nation during a very difficult time.  Their courage and professionalism is inspiring.   “While much progress has been made, there remain many challenges we face in Afghanistan.  The Taliban and their Al Qaeda allies are dedicated to perpetrating a violent and tyrannical society upon the freedom-loving people of Afghanistan.  We cannot and must not permit them to re-establish a safe-haven in that nation that would allow them to plot attacks against American families and our allies around the world.  “From my visits with our troops in Afghanistan, I have seen the progress we have made in training Afghani military and police.  I have seen the hard work of coalition forces and the Afghani government to build that nation’s infrastructure.  We are creating the foundation of a society that will no longer be a breeding ground for radical extremism.   “We must remain vigilant and dedicated to our mission in Afghanistan.  In the Global War on Terrorism, there are many fronts and many missions that demand our attention.  The men and women of our Armed Forces will not take their eye off the ball.  They are committed to winning this war, and we should support their efforts.  I am convinced the best way to protect American families at home is to defeat terrorists overseas.  “Again, I wish to thank Chairman Ackerman and my fellow committee members for this opportunity, and I look forward to the testimony from our witnesses.”

BILBRAY PRAISES DEPARTMENT OF HOMELAND SECURITY FOR MOVING TO COMPLETE BORDER FENCE

As Chairman of the Immigration Reform Caucus, I applaud today’s announcement by the Department of Homeland Security that it will waive certain legal requirements in order to complete hundreds of miles of fencing along the U.S.-Mexico border. Today’s decision by the Department of Homeland Security paves the way for construction of 470 miles of much-needed border fencing.  The completion of this fence – which will total 670 miles when finished – is one of many initiatives that are being undertaken to stop the flow of illegal immigration into our country.  I applaud the Bush Administration and the Department of Homeland Security for recognizing the importance of moving forward with this fence without any further delays.  The American people demand that our borders be secured and this decision will go a long way toward accomplishing that.

On this April Fool’s Day, House Republican Leader John Boehner (R-OH) today released written testimony of Venezuelan President Hugo Chavez, who was not invited to today’s Select Committee for Energy Independence and Global Warming hearing on the oil industry.  Chavez, whose state-owned CITGO is the world’s sixth largest oil supplier, would enjoy significant tax breaks under energy legislation recently passed by the Democrat-led House, in spite of the socialist dictator’s threats to cut off energy supplies to the United States and ongoing anti-American rhetoric and policies.  President Chavez’s testimony follows:   Testimony of Hugo Chavez, President of Venezuela Select Committee for Energy Independence and Global Warming Hearing on “Drilling for Answers: Oil Company Profits, Runaway Prices and the Pursuit of Alternatives” April 1, 2008   Chairman Markey, though I was unable to attend today’s hearing in person, I hope you will accept this written testimony.  More importantly, I hope you will accept my sincere ‘thank you’ for the tax breaks the new Democratic Majority provided to my state-owned oil giant, CITGO, in recent ‘energy’ legislation passed by the House of Representatives.    It is especially relieving to know that while CITGO receives these tax breaks, five other major oil companies – including American-owned companies employing thousands of working Americans – will be forced to pay higher taxes, raising energy costs on consumers in your country and endangering scores of jobs as well.  Please extend my gratitude to Speaker Pelosi, Majority Leader Hoyer, Whip Clyburn, Chairman Emanuel, and everyone who played a role in scheduling this legislation for a vote in the House of Representatives.   Being a socialist dictator is a difficult – and often lonely – burden these days.  As more nations move toward democracy, the number of socialist dictators in our world is declining, and we can use all the help we can get.  As I seek to keep our socialist movement afloat in South America, it is comforting to know that I have such strong allies in the House Democratic Majority.    Though the American economy is struggling and families in your country are feeling the strain from rising costs for everything from food to fuel, I’m pleased the House Majority did not allow these realities to stand in the way of your admirable efforts to raise taxes on them in order to pay for more government spending and, more importantly, my own tax breaks.    Moreover, I am so grateful that you have overlooked my repeated threats to cut off Venezuelan energy supplies to your nation and my consistently cozy relationship with the Castro regime in Cuba – regardless of which Castro is in charge.  To know that I will receive tax breaks not provided to my global competitors, even in spite of my radical Left-wing, authoritarian ideology, gives me great confidence in my future relationship with this Congress.    Before I conclude, I hope you will permit me to make two additional pitches for policy actions out of this Congress.  First, Chairman Markey, I want to applaud the ongoing support that has reportedly been provided by at least one of your House Democratic colleagues for my Marxist brothers in the Colombian FARC – a terrorist organization I have been working closely with to expand my influence in that nation.  News reports recently detailed a trip one senior House Democrat made to Colombia to force Colombian President Alvaro Uribe – an American ally – to position me as a mediator between Colombia and the FARC.  As you might expect, I wholeheartedly supported that effort and strongly encourage similar meetings in the future as well.    Likewise, Mr. Chairman, I strongly encourage you to impress upon your Democratic colleagues how vital it is to my influence in South America that the Majority continues bottling up the so-called U.S.-Colombia free trade agreement.  As you might expect, free trade between your nation and my neighbors in Colombia would be a sharp blow to my efforts to expand my reach throughout South America, and any assistance you can provide me in derailing the agreement would be most appreciated.   In conclusion, Mr. Chairman, though I understand not being invited to today’s politically-motivated, made-for-TV hearing on the oil industry, please know that I am ready and willing to provide whatever assistance I can to advance the House Majority’s policy goals, on energy and otherwise.  I hope you will relay that message to your Democratic leadership team, and I appreciate the opportunity to thank you for your ongoing assistance to my socialist regime.

As Chairman of the House Republican Policy Committee’s Task Force on Capital Markets, Economic and Information Security,  I believe the Treasury plan is a solid blueprint offered at a critical time. The Blueprint recognizes that to protect investors and provide stability to the markets requires us to modernize and reform the entire system of financial services regulation. We cannot offer stop-gap, band-aid fixes.  A flexible and responsive regulatory system will best provide for the economic growth and job creation that comes with a strong financial services industry.   Many aspects of the Treasury’s plan, including a greater systemic role for the Federal Reserve and consolidation among banking regulators, are consistent with the principles I have unveiled for legislation to reform the system of financial services regulation.  This blueprint, as well as the many other reports issued over the past year, shows Congress the way forward. The only question now is whether Congress will choose to act wisely or veer off towards overregulation. Congress must recognize the events of recent weeks are a call to action. The debate in the weeks ahead will be essential. I commend Secretary Paulson and his colleagues for their work in addressing the competitiveness of the U.S. capital markets.

As a member of the House Financial Services Committee, I believe it’s imperative that the United States Congress closely examine the recent plan presented by Secretary Paulson. Increased federal regulations are not the answer to our nation’s current economic concerns. Like most Americans, I want market discipline—but the Congress cannot create that by needlessly empowering the Fed. Despite the new ideas offered by the Department of Treasury I believe it’s critical that Congress focus first on the Fed’s recent actions to involve themselves in the Bear Stearns bailout. Without a thorough review of these measures, we will not be able to adequately review the Treasury plan. I want to be assured that the Fed’s action will not leave our nation’s hardworking taxpayers on the hook. I look forward to the opportunity to question Secretary Paulson and Chairman Bernanke about the actions leading up to Federal Reserve’s decision to intervene.

I continue to view Iraq with cautious optimism, but it is undeniable that the violence has dropped dramatically due in large part to the skill and courage of our armed forces along with the counterinsurgency strategy known as the Surge. The United States has a vital national security interest in ensuring Iraq is a stable and valuable partner in the War on Terror. There has been significant progress toward that goal. As long as our military leaders believe we have role to play in that objective and it is achievable, we should continue to offer our support to the Iraqi people.

I am very encouraged by the President’s tough stand against wasteful spending in Washington. He pledged to veto any future spending bills that do not cut earmarks in half – building on the steps Republicans have proposed to rein in pork barrel spending.  We simply must put an end to the addictive tax and spend mentality that has run amok here in Washington.  I do, however, have serious concerns about some of the President’s new initiatives, particularly those that would expand federal reach into education policy. If we are truly interested in improving public education in America, we need to remove Washington bureaucrats from the equation and return the control and accountability to local communities where they can effectively meet the needs of local students, teachers, and parents.”

A Win for Small Business

Today, I was able to score a win for small business. SEC Chairman Christopher Cox announced that he would extend the deadline for small businesses to file required reports under Section 404 of the Sarbanes-Oxley law.  This fight is something I’ve been very active on because I know that small business is the engine of the American economy and that the current Sarbanes Oxley regulations are choking them with red tape and paperwork.

I just finished my morning run here in Washington today. As I came down off the steps of the Lincoln Memorial, I began to hear in the distance names being called, one at a time over a loud speaker. As I got closer and closer to the Vietnam Memorial, I saw a small group gathered there. One man with a microphone was reading one name at a time – every single name off of the Vietnam Memorial Wall, remembering that every single life was a huge sacrifice for all of us and our entire nation for the principles we hold dear: freedom and liberty. We, as a nation, depend on trade.  I know that there are groups in this country that chose to ignore that point, but it is a fact.  Our nation is the number one trading nation in the world.  More than any other factor, our economy relies on international commerce to sustain economic growth and employment.   Consider these facts:  one in every five manufacturing jobs is tied to overseas sales; one in every three rows of crops are planted to be exported; and one third of the growth of the U.S. economy over the past 20 years came through exports.

Looming Financial Crisis: Red, White, and Blue Issue

The retirement of the baby boomers will present a demographic challenge to entitlement spending like we have never seen before in this country. The first wave of 3.2 million baby boomers turns 62 next year. In 2011, they'll turn 65 and be eligible for Medicare.   Republicans and Democrats have done the math – everyone seems to be aware that our country is living on borrowed dollars and borrowed time. It’s disheartening that we can agree on the problem, yet the partisan political divide in Congress has prevented active pursuit of solutions. The field of presidential hopefuls has also fallen silent on addressing entitlement reform.   We can’t afford to let the financial tsunami closing in on our country to be an issue that we let fall by the wayside. Mandatory spending today will translate into an unbearable burden for our grandchildren tomorrow. Getting our fiscal house in order isn’t a red or a blue issue; it’s a red, white, and blue issue.       Jim Cooper and I have introduced bipartisan legislation that will establish a commission, eight Republicans and eight Democrats, including up to four serving members of Congress. The SAFE Commission (H.R. 3654) would review entitlement spending and tax policy to find the best way to stem the tide of our unsustainable fiscal policy. The commission would also include the secretary of Treasury, the director of the Office of Management and Budget, and other appointees who are experts in fiscal matters. Modeled after the BRAC process, Congress would be mandated to vote up or down on a legislative proposal. Enabling members of Congress to vote on the heart of this issue is what makes the SAFE Commission unique.     I realize tackling our enormous debt and ramifications of spending beyond our means may not be the most pleasant topic. Realistic ways of steering this country back to sound financial footing may not be easy either. Does that mean we shouldn’t care?    The Heritage Foundation, the Concord Coalition, the Brookings Institution, the Committee for a Responsible Federal Budget, and U.S. Comptroller General David Walker all support the SAFE Commission Act. I am hopeful that by joining efforts across the aisle with Jim Cooper and others, our colleagues in the House and Senate will embrace this bipartisan legislation.

Communist Chinese Hacking of the Pentagon Unacceptable

The control of information is critical to national security. This asset was compromised as reported in the London Times AP story in the Washington Post recently, last week. It was compromised from a cyber attack against the Department of Defense's unclassified e-mail system, which included the e-mail accounts of Defense Secretary Robert Gates. While the Pentagon does not have sufficient proof to formally make an accusation, China is the prime suspect. The responsibility is unclear, because China is home to many insecure computers and networks that hackers in other computers could use to simply disguise their locations and launch these attacks, making proper attribution difficult.

The shrinking share of foreign IPO listings on New York's financial markets has had Wall Street fretting of late, wondering if it's about to lose its status as the world's financial capital.   Now Congress is taking note too. Late last month House Republicans tapped New York congressman Vito Fossella to chair a panel to explore what might be impeding the competitiveness of U.S. financial markets worldwide.   The Capital Markets, Economic, and Information Security Task Force is a project of the House Republican Policy Committee, a panel comprised of GOP leadership and top committee members, which explores various issues and makes legislative recommendations based on their findings.   During a stop in Chicago today, Fossella stopped to talk with CNBC’s Rick Santelli on the floor of the Chicago Mercantile Exchange. The interview appears in two parts on this page.   The New York congressman was in the middle of a day-long field hearing, including panels with members of the CBOT, the CME, the Chicago Stock Exchange, and other Midwest regional boards of trade.   “Our main purpose is to ensure that the U.S. remains the envy of the world when it comes to raising capital," Rep. Fossella told Santelli of his committee. "We need to realize it’s no longer the only game in town.”   Fossella said that the implementation of legislation like Sarbanes-Oxley, while protecting investors, runs the risk of becoming too burdensome for companies, sending capital that used to come to U.S. shores elsewhere, like markets in Europe and Asia.   Fossella hopes to hold at least ten hearings similar to the Chicago meetings in major market hubs across the nation, like New York and Philadelphia. The objective is to collect ideas on regulation and how to best bring innovative vehicles to the market without too many burdens. He’ll take his conclusions back to Capitol Hill and work with Republican colleagues to create what the caucus sees as the most suitable legislative solutions.   The chief item Fossella would like to see his panel -- and both parties of Congress -- accomplish? "I think as Democrats, Republicans, and Independents, we need to keep America strong in the global marketplace. Not just for the traders on this floor. Senator Barack Obama (Illinois) wrote an Op/Ed piece in this morning's Miami Herald that talks about his hope for a Cuba free from the dictatorial tyranny of Fidel Castro.  While the goal of a democratic Cuba with free elections is an important step towards liberating the Cuban people, Senator Obama's call to ease the embargo against Cuba is not the way to go.

Recently, I wrote an op-ed in the Detroit News on CAFÉ standards. I believe Congress should support American manufacturing and American workers and lean on input from and cooperation with the American automotive industry as we consider reforming CAFÉ laws. Unfortunately, Senate Democrats recently chose to do the exact opposite in passing their energy bill, and the House must work to dramatically reform the Senate legislation.

This Farm Bill will Reap what it Sows

Mr. Speaker, it is a sad day for American agriculture when the Democratic Leadership pits America’s farmers and ranchers against America’s working class. The tax increases included in this bill stand to jeopardize millions of American jobs by raising taxes on companies that do business in the U.S. Not only does this provision, cunningly added by the Democrat Leadership after the bill left the control of the Agriculture Committee, jeopardize American jobs, it stands to abrogate treaties with other nations and lead to significant ramifications for U.S. companies with operations in other countries. Worst of all, we’re not even considering a tax bill: we’re considering a farm bill, a farm bill that has been twisted into a partisan pawn.

I recently got back from my sixth trip to Iraq.  In the year since I last visited there, a lot has changed both at home and in Iraq over that time.  There is no question that the news reports coming out of Iraq have almost been universally pessimistic for about 10 months' time.  I was obviously very concerned about what I would encounter upon my return to that country, but during the very short trip, I learned a great deal.

As strongly as I support reauthorizing the SCHIP program, it was my responsibility to highlight the CHAMP Act's egregious failings, which Democrats seem content to ignore.  The Democratic leadership never intended to give us a chance to fix this bill.  We were given a few hours of meaningless debate, but we did not have the opportunity to offer even one amendment to protect our nations' seniors from this bill.

'Godless' Coins Once Again in Circulation

On February 15 of this year, the U.S. mint issued a dollar coin with the likeness of George Washington, our first President.  The properly struck coins are inscribed along the edge with “In God We Trust,” “E. Pluribus Unum” and the year and mint mark.  Three hundred million coins were struck, but as many as 50,000 were released into circulation without the “In God We Trust” inscription.

The Food and Drug Administration was created in 1938 by the Federal Food, Drug, and Cosmetic Act for myriad reasons, not the least of which is to ensure that the nation’s supply of pharmaceutical drugs is safe.  Many Americans take for granted the fact that when a physician (like myself) writes a prescription, the patient can go to literally any pharmacy in the country and get the medication he or she needs without worrying about whether or not the pharmaceutical product is the real deal.

Hamas Victory a Defeat for Peace

Hamas’ victory in seizing control of the Gaza Strip represents a defeat for peace, democracy and a sovereign Palestinian state. There is no negotiating with a terror group who’s singularly focused on the destruction of Israel. Hamas has never been interested in peace or governing. Its bloody-thirsty leaders crave murder, violence and the complete annihilation of Israel. The world must unite in its opposition to Hamas and send a strong message that its reign of terror will no longer be tolerated. We must also stand by our friend and ally, Israel, as it confronts the reality of a radical Islamic state on its border.

The Department of Veterans Affairs (VA) has stated that their goal is to provide excellence in patient care, veterans' benefits and customer satisfaction.  Yet one of the major concerns that I continue to hear from veterans in Virginia’s 2nd Congressional District regarding the VA is that of bureaucratic delays resulting from a strained and backlogged claims system.

Apologists at the New York Times

The pro-Amnesty movement is revving its engines in preparation for a radical May 1st national rally.  And the New York Times recently did its part to push the pro-Amnesty agenda.  The article from April 16, casts illegal immigrants as earnest, law-abiding residents, who by happenstance, find themselves in the Unites States against the law.  Even more brazen, the article names illegals who are filing federal taxes.  One illegal named in the story, openly admits that her social security number on her W-2 is stolen. 


First, let’s state the obvious.  If federal immigration enforcement officials do not prosecute those illegal immigrants named in an article, why should we have border enforcement at all?  If we believe in the rule of law, the authorities have a responsibility to investigate and arrest anyone who admits to a crime and is named in a public source.

If we are to stay a lawful democracy, we must enforce the Rule of Law.

In the past, I have noted how the Republican Party neglected to send me the memo renouncing anti-communism; and how someone neglected to send the communists a memo informing them they were no longer evil.  I imagine the latter memo read thus:
