WASHINGTON, D.C. – Congresswoman Lois Capps (CA-23) released the following statement regarding CMS’s letter on the Recovery Audit Contractors Program:
“I appreciate that a month after our original deadline CMS has finally decided to respond to our repeated requests for written information about the Medicare Recovery Audit Contractors (RAC) demonstration program. Unfortunately, CMS’s response is a day late and a dollar short as it does not address how it will rectify many of the problems that have arisen since the beginning of the demonstration program, nor does it adequately elaborate on how it will prevent many of these problems in the future. This deeply flawed program is already harming healthcare providers and threatening patient care in California, New York and Florida and it is poised to expand to other states in the coming months. Since CMS has not sufficiently addressed our serious concerns with the program, I plan to continue pursuing my legislation at this time. I appreciate the widespread interest in my legislation that my Congressional colleagues have shown and I hope that a solution to this problem will soon be found.”
