Nadler: “A Sad Day for Families, a Sad Day for Justice”

New York State Court of Appeals rejects gay marriage, punts to legislature

WASHINGTON, D.C. – The New York State Court of Appeals ruled today that the state Constitution does not guarantee marriage rights for same-sex couples.  Congressman Jerrold Nadler released the following statement:

“This is a sad day for families, a sad day for justice, and a sad day in the struggle for equal rights for all Americans.  The promise that, in this nation, all people are created equal, and entitled to equal rights, compels us to end discrimination against same-sex couples.   Today, the Court of Appeals has failed to take that stand. 

Who will stand up for equal justice in America? 

 The rights of LGBT families are already under attack in Washington.  A Constitutional amendment that would strip states of their power to define marriage for themselves comes before Congress once a year.  As part of their cynical election-year ritual, the Republican majority in will soon force a vote on this amendment.  If adopted, it would prohibit states that want to accord equal rights to all families of the ability to do so.  

The time to act is now.  It is imperative that the state legislature protect families’ rights before its hands are tied by an immoral Congress and a President sworn to the agenda of the radical  right.  There is no excuse for inaction, nor for delay.

Come what may, we will continue to fight for equality, dignity, and recognition of lesbian and gay Americans and their families.  We will challenge discrimination and we will work to fulfill the true American values of tolerance and justice.”
