District of Columbia v. Heller

During its current term, the United States Supreme Court will hear arguments on the District of Columbia’s right to ban private ownership of handguns. It will be the first time since 1939 that the Court specifically addresses gun rights, as covered in the “bear arms” clause in the Second Amendment of the Constitution, which states:

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed.

While specific to the one city’s law, the case of District of Columbia v. Heller will have national implications. Many cities and states regulate or limit firearm possession. Should the high court rule against DC, the decision may lead to challenges in jurisdictions where handgun ownership is restricted or prohibited.

Congressman Fattah has been joined by 17 of his colleagues in filing an amicus brief in support of reversal of the ruling by the U.S. Court of Appeals that struck down the District of Columbia’s handgun ban.
