Examples of education inquiries Senator Kyl can make on behalf of constituents:

“I am having problems repaying my student loans. Can Senator Kyl help me?”

Senator Kyl can inquire with USA Group Services, the organization which administers the loans, about the status of your loans after receiving your written authorization.

“My school closed before I finished my program. What about my student loan?”

If your school closed while you were attending, you may be eligible for a partial cancellation of your loan. Senator Kyl can inquire with the Department of Education if provided with the appropriate supporting documentation.

Examples of education inquiries Senator Kyl cannot make:

“My child is having problems with the principal at the middle school. I would like Senator Kyl to help our family.”

While Senator Kyl would like to assist with a problem like this, it is not within his jurisdiction to get involved with issues at the local level. The appropriate body to contact in a case like this is the school board for that school district.

“I do not want to repay my student loans. Can Senator Kyl assist me in getting my loans canceled?”

There are established criteria for the cancellation of loans, which the Senator can provide to you. If you do not meet these criteria, there is nothing Senator Kyl can do to cancel your loans, and you are responsible for repayment.

Example of an EEOC inquiry Senator Kyl can make on behalf of constituents:

“I filed a complaint against an employer, but I haven’t heard anything from the EEOC.”

With proper authorization, Senator Kyl can check on the status of your complaint.

Example of an EEOC inquiry Senator Kyl cannot make:

“I am suing my former employer for discriminating against me. What can the Senator do to help me?”

Under the rules of the Senate, Senator Kyl cannot intervene in any court proceedings.

Example of a HUD inquiry Senator Kyl can make on behalf of constituents:

“I have a complaint about my Section 8 housing, but no one at HUD will look into it.”

Senator Kyl can forward your complaint to the agency for its review and response.

Examples of immigration inquiries Senator Kyl can make on behalf of constituents:

“I filed my application for permanent residence over two years ago, and I haven’t heard anything from the INS.”

The staff in both Phoenix and Tucson receive updates of the INS processing times for the most common applications filed. If your application is beyond the reported processing time, Senator Kyl can contact the INS to check on the status of the application and find out how much longer it will be until it is adjudicated.

“I have filed to become a United States citizen. I have had my interview and taken my tests. All that is left is to take the oath of citizenship. When will I be sworn in?”

Senator Kyl can contact the INS and ask when it is anticipated you will be scheduled to attend an oath ceremony.

Examples of immigration inquiries Senator Kyl cannot make:

“The INS is taking too long to process my application. Can’t Senator Kyl tell the INS to get moving on my case?”

It is not within Senator Kyl’s jurisdiction to tell an agency what to do. It would not be fair for Senator Kyl to ask the agency to process your application ahead of all the others filed before yours. If there is a genuine emergency, the agency has an established procedure for requesting expedited processing.

“I am being deported, and I am going before an immigration judge soon. What can the Senator do to help me?”

Senator Kyl cannot intervene in any court proceedings, including hearings with immigration judges, under the rules of the Senate.

Examples of a tax inquiry Senator Kyl can make on behalf of constituents:

“I have received a notice from the IRS that I underpaid my taxes three years ago. I think they are wrong. Can the Senator look into this?”

With proper written authorization and the appropriate supporting documentation, Senator Kyl can inquire with the IRS about the reported underpayment. After receiving the inquiry, the IRS Problem Resolution Office often asks if it can work directly with the taxpayer, if he or she agrees, to resolve the problem.

Example of a tax inquiry Senator Kyl cannot make:

“The IRS still maintains that I owe back taxes. I am appealing that decision. Can the Senator help me?”

Senator Kyl cannot intervene in any court proceedings under the rules of the Senate. He can only inquire about the status of the appeal and request to be notified when a final decision has been made.

Examples of Department of Labor inquiries Senator Kyl can make on behalf of constituents:

“I have filed a claim with Workers’ Compensation for a work-related injury. I haven’t heard anything from them since my last doctor’s appointment.”

Senator Kyl can contact the OWCP office in San Francisco, which handles Arizona claims, and inquire about the status of the claim.

“I have questions about how my pension works. Can the Senator help me?”

If you have checked the DOL web page and still have questions, Senator Kyl can contact the agency on your behalf and request that it provide clarification or explanation of your questions.

Example of a Department of Labor inquiry Senator Kyl cannot make:

“The OWCP has denied my compensation claim. I want Senator Kyl to help me get the compensation I deserve.”

It is not within Senator Kyl’s jurisdiction to tell an agency what to do. In this case, he can contact OWCP and inquire why the claim was denied, but he cannot tell the agency to approve the claim.

Examples of Medicare inquiries Senator Kyl can make on behalf of constituents:

“My wife’s claim for a doctor’s visit was denied by Medicare. Can the Senator look into this?”

With proper authorization from the constituent, Senator Kyl can contact Medicare Part B and ask why the claim was denied. It should be noted that there is an established procedure for requesting a reconsideration of a decision.

“Medicare will not approve a request for a wheelchair that I really need. What can the Senator do?”

Senator Kyl can contact CIGNA in Nashville, the agency which processes durable medical equipment claims for Arizona, and check into why the request has not been approved.

"I signed up for Medicare, but Medicare does not show that I am enrolled. Can Senator Kyl help?”

Senator Kyl can contact the Social Security Administration, the agency responsible for enrolling people into Medicare, and inquire about this oversight.

Examples of an active duty military inquiry Senator Kyl can make on behalf of constituents:

“I wish to join the miliary, but I have been rejected for medical reasons. Can the Senator help me?”

With proper authorization and supporting documentation, Senator Kyl can inquire about a constituent’s enlistment with the military branch.

Examples of retired military inquiries Senator Kyl can make on behalf of constituents:

"I am not receiving the proper amount of retired pay. Can the Senator look into this for me?”

Senator Kyl, with written authorization, can forward information about this constituent’s problem to the DFAS Cleveland Center for its review and response.

“I am experiencing difficulties with TRICARE not covering treatment my doctor says I need.”

The Senator can inquire about this issue after the constituent provides a written explanation of the problem and supporting documentation.

Example of a USPS inquiry Senator Kyl can make on behalf of constituents:

“I do not think I am receiving my mail in a timely fashion. Will the Senator look into this?”

Consumers with complaints should first contact the station responsible for their mail delivery. If you are not satisfied with the station’s response, Senator Kyl can forward your complaint to the USPS for its review and response.

Examples of Social Security inquiries Senator Kyl can make on behalf of constituents:

“I submitted a claim for disability benefits several months ago, but I haven’t heard anything from the SSA in quite a while.”

Senator Kyl can inquire with the SSA or with Disability Determination Services, the state agency that does the medical reviews for disability claims, about the status of the claim.

“My retirement benefit is not correct. Can Senator Kyl help me?”

With proper authorization, Senator Kyl can inquire with the agency and request a breakdown of how the retirement benefit was calculated. Often, some of the worker’s earnings were not reported to the SSA, and proof of those earnings can be submitted to the SSA and a recalculation of benefits done.

Examples of Social Security inquiries Senator Kyl cannot make:

“The SSA has denied my disability claim, and I have appealed that decision. What can the Senator do to help me?”

Senator Kyl cannot intervene in any court proceedings, including hearings with Administrative Law Judges, under the rules of the Senate. He can only inquire about the status of the appeal and request to be notified when a final decision has been made.

“I have applied for disability, but it is taking too long to process. I cannot afford to wait for my benefits. Can Senator Kyl help me?”

It is not within Senator Kyl’s jurisdiction to tell an agency what to do. It would not be fair for Senator Kyl to ask the agency to process your application ahead of all the others filed before yours. If there is a genuine emergency, there are established procedures for requesting expedited processing.

Example of a passport inquiry Senator Kyl can make on behalf of constituents:

“I submitted my application for a passport several weeks ago, and I’m leaving on my trip soon. Why haven’t I received my passport yet?"

The San Francisco Passport Agency processes passport applications filed by U.S. citizens residing in Arizona. Senator Kyl can contact the Passport Agency to check on the status of the passport if the normal processing time has elapsed. If you need an expedited passport, you can pay additional fees for processing and for express delivery to and from the passport facility.

Examples of veterans inquiries Senator Kyl can make on behalf of constituents:

“I have not heard from the VA regarding my disability claim. I need to know the status of my claim.”

Senator Kyl can contact the VA to inquire about the status of your claim. Please be aware that these types of claims can take a long time to process.

“I am being denied care from the VA hospital because of my income level. What can the Senator do to help me?”

The VA has instituted an enrollment system based on priority categories established by law. With proper authorization, Senator Kyl can ask the VA to review a constituent’s enrollment category.

“I have a complaint about the way I was treated at the VA hospital while there for a doctor’s visit.”

Upon receiving your written complaint, Senator Kyl can forward it to the VA hospital for its review and response.

“I have been trying to get a copy of my records from the NPRC with no luck. Can the Senator help me?”

With your written permission, Senator Kyl can request a copy of your records for you.

Examples of veterans inquiries Senator Kyl cannot make:

“The VA is taking too long to process my claim. Can’t Senator Kyl tell the VA to get moving on my case?”

Senator Kyl does not have the legal authority to tell an agency what to do. It would not be fair for Senator Kyl to ask the agency to process your application ahead of all the others filed before yours. If there is a genuine emergency, the agency has an established procedures for requesting expedited processing.

“My case has been pending at the Board of Veterans Appeals for a long time. Can Senator Kyl ask the board to make a decision on my case?”

Under the rules of the Senate, Senator Kyl cannot intervene in any appeals process. He can only inquire about the status of the appeal and request to be notified when a final decision has been made.

Examples of visa inquiries Senator Kyl can make on behalf of constituents:

“My family member was denied a visa to come visit me in the United States, but he was not told why his visa was denied.”

Senator Kyl can send an inquiry to the post overseas asking why the visa was denied.
For your information: The most common reason visitor visas are denied is that the applicant did not provide sufficient evidence that he or she is not an intended immigrant. The applicant must show he or she will return home after the visit by providing proof of ties to the home country. Some examples of documents which can be used to prove ties are rent receipts, utility bills, letters from employers, and bank statements.

“The immigrant visa petition I filed for my wife has been approved by the INS, but I have heard nothing further.”

After the INS approves an immigrant petition, it is forwarded to the National Visa Center, which is responsible for processing the affidavits of support associated with immigrant petitions. Then the case will be sent to the American Embassy or Consulate overseas which conducts the interview with the beneficiary and, if approved by the consular officer, issues the visa. Senator Kyl can inquire with the NVC or the post overseas as to the status of your petition.

Example of a visa inquiry Senator Kyl cannot make:

“It is taking too long to immigrate my spouse. Can’t Senator Kyl tell the Consulate to issue the visa?”

It is not within Senator Kyl’s jurisdiction to tell an agency what to do. It would not be fair for Senator Kyl to ask the agency to process your application ahead of all the others filed before yours. If there is a genuine emergency, there are established procedure for requesting expedited processing.
