Legislation Would Curb Lawsuit Abuse

November 30, 2005

The dramatic rise in frivolous lawsuits over the years has slowed down the technological innovation and development of new businesses.  At the same time, they produced little for victims and generate millions in fees for lawyers.  These frivolous abuses result in costs that are passed on to the American consumer.

The Lawsuit Abuse Reduction Act accomplishes two common sense goals to discourage lawsuit abuse:

-requires plaintiffs to pay the attorneys" fees of defendants when the judge determines that a frivolous lawsuit was filed

-reduces "court-friendly shopping" by requiring personal injury cases to be filed either where the plaintiff lives or was injured, or where the defendant's principal place of business is located

The Lawsuit Abuse Reduction Act passed the House with my strong support by a margin of 228-184. It is now up to the Senate to act on this much needed reform bill.
