Abercrombie supports independent
Ka Loko investigation

KILAUEA, Kauai-- Congressman Abercrombie, participates with members of the Ka Loko Dam Breach Action Alliance, at a press conference today called for an independent investigation into the March 14 Ka Loko dam failure.

“I agree that an independent investigation is needed and have conveyed my views directly to the Attorney General,” said Abercrombie.  “Too many of the questions about this event and the actions leading up to it involve the State of Hawaii and whether it properly discharged its duties.  It is likely, therefore, that the State will be embroiled in litigation as a result of the dam failure.”

Abercrombie continued, “If that occurs, any investigation by the Attorney General and his subordinates will be sharply questioned and its conclusions challenged.  The last thing the people of our State, especially the survivors, need is more questions, more turmoil and more accusations.  The search for the facts must be conducted in such a way that the public has every confidence in its straightforwardness, competence and transparency.  I believe that an independent investigator is an essential precondition for that confidence.

“I have the greatest respect for the Attorney General, his abilities and his integrity.  However, he is being put in an impossible position when he is asked to investigate events in which he and his client, the State of Hawaii, have an interest.”

“An independent investigation, whether conducted by a special deputy attorney general, or another outside party with no interest in the outcome, is the best approach,” Abercrombie said.
