Tell The Department Of Justice To Place An Immigration Court In North Carolina

It is essential that the Executive Office for Immigration Review (the branch of Department of Justice who oversees and runs immigration courts) establish a court in NC.  The establishment of an immigration court located in North Carolina will address both the needs of the growing legal immigrant populations, and the litany of problems the state is experiencing with illegal aliens. 

Currently, North Carolina is under the jurisdiction of the immigration court in Atlanta, Georgia.  This means that North Carolina doesn’t have the full tools and resources to deport illegal aliens in an expedited manner.  

Many times after an illegal alien commits a crime, he or she is given a notice to appear in court in Atlanta.  Obviously many of these individuals never show up and are allowed to remain in our country illegally.  

The distance to Atlanta is also a burden for legal immigrants who have to travel hours from NC to Atlanta to rectify simple paperwork mistakes that must be dealt with in immigration court.   

North Carolina’s illegal alien population is estimated at 300,000 to 600,000.  This makes North Carolina home to the nation’s 8th largest population of illegal aliens. Yet, of the ten states with the largest estimated populations of illegal aliens, North Carolina is the only one without an immigration court.

Action Item: I urge you to sign this petition to the Department of Justice, urging them to establish an immigration court in North Carolina.


Tell the Senate You Don't Support Their Amnesty Bill

The House-passed immigration bill will ensure that our borders are secure and eliminates the current “catch and release” policy for dealing with illegal immigrants apprehended in the United States.  Securing our borders is necessary before we can begin to address how to deal with the millions of illegals already living in our nation.

Unfortunately, the Senate’s immigration reform legislation will provide amnesty to millions of undocumented workers, providing further incentive for people to enter our country illegally.  This is unacceptable. 

Action Item: It is vital to contact the Senate Judiciary Committee’s Chairman and Ranking Member and Senate Leadership to let them know that immigration reform must begin with securing our borders and that any form of amnesty is not acceptable.

Tell the President You Want The Border To Be Secured

Our President supports immigration reform similar to the Senate’s reform bill.  Despite the fact that President Bush has been an ardent supporter of national security as we continue the War on Terrorism, the President does not seem to acknowledge the threat to national security posed by illegal immigration.

Action Item: Contact President Bush to let him know that it is imperative we secure our borders.  Our national security depends on it.

Stop Driver's Licenses From Being Given To Illegal Aliens

Currently, North Carolina and five other states allow the use of an Individual Taxpayer Identification Number (ITIN) as proof of identity when issuing driver’s licenses and identification cards.  A taxpayer identification number does not prove you are who you say you are.  This allows illegal aliens to come to North Carolina and get a driver’s license with nothing more than a slip of paper with numbers on it. 

The U.S. Department of Treasury has repeatedly told North Carolina not to use taxpayer identification numbers as proof of identity.  Yet, North Carolina's leaders will not stop this practice and it is making our state a magnet for illegal aliens.

To stop this Practice, Rep. Myrick has introduced two bills in Congress.  The first bill is H.R. 4380, the Transportation Revenue Ultimatum Enforcement (TRUE) ID Act.  This bill would withhold federal transportation funds for states who accept taxpayer identification numbers when issuing ID cards or licenses.  The second bill is H.R. 5506, State Accountability in Licensing Act.  This bill prohibits employers from using state driver’s licenses for the purposes of establishing identity for employment eligibility verification if the state who issued the license permits the use of taxpayer identification numbers in the application process.

Action Item: Contact Governor Easley and the North Carolina General Assembly to let them know you oppose North Carolina’s use of taxpayer identification numbers for identity verification when issuing state licenses.  Also, if Rep. Myrick is not your Representative, contact your Member of Congress and tell them to co-sponsor and support Rep. Myrick's TRUE ID Act (H.R. 4380) and the State Accountability in Licensing Act (H.R. 5506).

Help Rep. Myrick Pass The SHARE Act

Rep. Myrick has introduced legislation that would require the Commissioner of the Social Security Administration to send written notice to an employer when any employee’s social security account number does not match relevant records maintained by the Social Security Administration.  Furthermore, the bill requires the Commissioner of the Social Security Administration to simultaneously submit a copy of such notice to the Secretary of the Department of Homeland Security. 

This legislation allows the Department of Homeland Security access to information which could indicate that an employer is hiring illegal aliens.  If a certain employer has a high number of discrepancies in his or her employees’ wage records, the Department of Homeland Security will then be able to determine if an investigation is in order.

Basic Pilot Employment Verification Program

The Basic Pilot Program is available to employers across the country.  It is voluntary and free to use, and if you own a business you should seriously consider making this part of your hiring process. 

Often, illegal aliens will use fraudulent documents in order to obtain employment.  The Basic Pilot Program involves checking documents of newly hired workers, such as Social Security Cards, to make sure they are not illegal aliens.  All businesses have to do is go on the Department of Homeland Security pilot program website and enter basic employee information.  Homeland Security then checks that information against databases maintained by the Social Security Administration and their own extensive databases.  After the check is done, the business is notified if the new employee is legal and can continue to work there, or if they are illegal.

Level The Playing Field For Businesses Playing By The Rules

We need to secure our borders, but we also need to deal with the demand side of illegal immigration.  Hiring an illegal alien is against the law!  The current fine for a business hiring an illegal alien is $250 per alien.  Rep. Myrick has  introduced a bill in Congress that raises that civil fine to $10,000 per alien, and will give the local or state law enforcement agency involved in the crack down an 80 percent cut of the fine.  The local or state agency can then use that money to increase their fight against illegal immigration.  This bill, called the 10k Run for the Border Act, will not hurt any business that follows the law.  This bill is intended to crack down on businesses that knowingly hire illegal aliens to gain an upper hand on other businesses.  That practice will no longer be tolerated, and those businessmen who do hire illegal aliens have been warned.

Stop Illegal Aliens From Using Fraudulent Social Security Numbers

Believe it or not, your Social Security Number could be used fraudulently by an illegal alien to fill out wage records necessary to get a job.  What’s worse, the Social Security Administration is aware this is going on but does nothing to let the rightful owner of the Social Security number know that his or her number is being used illegally!

Rep. Myrick has introduced legislation that requires the Commissioner of the Social Security Administration to promptly notify the individual originally issued a Social Security number if it is determined that another individual has used the number in a fraudulent or otherwise illegal manner.

Stop Your Federal Tax Dollars From Going Into The Pocket Of Illegal Aliens

Rep. Myrick believes illegal aliens shouldn't be hired for projects that are funded by your tax dollars.  Unfortunately, contractors often bite the hand that feeds them by hiring illegal aliens to work on projects using your federal tax dollars. 

Rep. Myrick has introduced a bill called the Federal Contract Accountability Act.  This bill would punish employers who knowingly use illegal aliens on federally-funded projects by making these contractors ineligible for federal contracts for a period of two years.  Further, any project (state or local) receiving federal money would lose any federal portion of funding if it is determined that illegal immigrants were knowingly hired to work on the project.
