A bill to amend the Federal Water Pollution Control Act to clarify certain activities the conduct of which does not require a permit.

Description: Some recent court decisions have held that the Environmental Protection Agency must require Clean Water Act NPDES permits for farmers and ranchers to apply agricultural pesticides. This new requirement is court-created and outside of the intent of the Clean Water Act. It is duplicative and unnecessary because of the strong controls placed on pesticides by the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). The requirement serves mainly to create more federal red tape and bureaucracy for farmers and ranchers to cut through if they use pesticides. I cosponsored this bill to help cut through unnecessary red tape and bring common sense back to Clean Water Act regulations.
