Date Introduced: 06/20/05 Bill Number: S.1269 Description: Some recent court decisions have held that the Environmental Protection Agency must require Clean Water Act NPDES permits for farmers and ranchers to apply agricultural pesticides. This new requirement is court-created and outside of the intent of the Clean Water Act. It is duplicative and unnecessary because of the strong controls placed on pesticides by the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). The requirement serves mainly to create more federal red tape and bureaucracy for farmers and ranchers to cut through if they use pesticides.
