Agricultural Protection and Prosperity Act of 2006

Description: Farmers and ranchers have for hundreds of years safely used animal manure, a naturally occurring organic material, as a fertilizer. Recently, a number of lawsuits have been filed that seek to classify manure from animal feeding, farming, and ranching operations as a hazardous material and regulated under the “Superfund” laws, the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) of 1980 and Emergency Planning and Community Right-To-Know Act (EPCRA) of 1986. The Superfund was created to clean up some of the worst industrial toxic waste sites and spills. Congress never intended the law to regulate animal manure. If this effort were to succeed, virtually every farm and ranch operation could potentially be exposed to liabilities and penalties under the act. Clean air and clean water are fundamental to maintaining our quality of life in Wyoming. Fortunately the Clean Water Act, Clean Air Act, Federal Insecticide, Fungicide and Rodenticide Act, and other environmental laws adequately regulate our agricultural operations and protect our water and air.
