Stolen Valor Act of 2005

Description: This bill amends US Code to penalize distributors of phony medals and those who fraudulently claim to be decorated veterans. Current law allows prosecution of imposters who wear an unearned Medal of Honor. S. 1998 would place criminal penalties on those who wear other medals, such as the Purple Heart, Silver Star, or a Distinguished Service Cross under false pretenses. Specifically, S. 1998 would expand the prohibition against wearing, manufacturing, or selling military decorations or medals without legal authorization to prohibit purchasing, soliciting, mailing, shipping, importing, exporting, producing blank certificates of receipt for, advertising, trading, bartering, or exchanging such decorations or medals without authorization. The bill would also prohibit falsely representing oneself as having been awarded any decoration or medal authorized by Congress for the Armed Forces or any of the service medals or badges, with increased penalties for violations if the offense involves a Distinguished Service Cross, an Air Force Cross, a Navy Cross, a Silver Star, or a Purple Heart. Military decorations are earned through great personal sacrifice, and this bill imposes consequences on imposters who would shamefully and fraudulently wear medals they do not deserve. As a former Marine and a proud supporter of the men and women who wear our nation’s uniform, I am honored to be a cosponsor of this important legislation.
