Medical Liability
MEDICAL LIABILITY
The medical liability crisis in the United States is reaching a breaking point. Doctors are leaving their practices and patients are losing access to critical health care. The cause of this situation is clear - increasingly aggressive and non-meritorious litigation against doctors, which leads to souring medical liability insurance premiums. Doctors in high-risk specialties are hardest hit by this crisis, causing communities around the country to go without a trauma surgeon, neurosurgeon or perionatolgist. As access to critical health services has decreased and the cost of healthcare has increased, this crisis has hurt patients the most.
It is critical that the U.S. Congress send the President a bill addressing this crisis this year. Without this legislation, health costs will continue to skyrocket, health premiums will become more burdensome for employees, and the medical community will be gutted of important experience as older doctors opt for early retirement over an increasingly litigious work environment. Texas has already seen the benefit of addressing the medical liability crisis in the state when it passed a Constitutional Amendment addressing the issue on August of 2003. Already insurance rates are lower, more insurers are offering coverage, and doctors are returning to the state. Even though Texas voters provided relief to Texas doctors, I believe a national solution is still needed. I am working hard to bring all parties to the table and send a bill to the President that addresses this crisis.
