H.R.6061 Secure Fence Act of 2006
The Secure Fence Act authorizes building 700 miles – nearly 10 times the fencing currently in place – of double-layered fencing at specific, targeted locations along the southern border. The measure would also require the Department of Homeland Security to maintain operational control over the entire border through a virtual fence – using cameras, ground sensors, Unmanned Aerial Vehicles, or UAVs, and integrated surveillance technology. Finally, this legislation looks at how we can strengthen our border personnel’s authority to disable fleeing vehicles. The Senate approved H.R. 6061 by a 80 to 19 vote.

S.3930 Military Commissions Act
The Military Commissions Act is a legislative fix for the Supreme Court's ruling in , which invalidated the military commissions that were being used to prosecute war criminals at Guantanamo Bay. The legislation allows the Central Intelligence Agency to continue its program for questioning key terrorist leaders and operatives to thwart terrorist attacks. It also provides a legal framework for prosecuting terrorists who the United States captures on the fields of battle. The Military Commissions Act guarantees that every terrorist will receive a full and fair trial, consistent with America’s obligations under international and domestic law.

On a cloture motion for a bill to express the policy of the United States regarding the United States relationship with Native Hawaiians and to provide a process for the recognition by the United States of the Native Hawaiian governing entity. Senator Hatch has a special place in his heart for the Native Hawaiian people in Hawaii, in Utah, and throughout the country. He counts Senators Inouye and Akaka as friends. He was concerned, however, about the constitutionality of this bill. The Department of Justice issued a strongly worded letter urging the Senate not to adopt the legislation, and given that, he thought that it was not appropriate to move forward on this bill.

In 2004, Utah received $254 million in federal highway funding, yet UDOT maintains the state is unable to increase capacity or maintain existing infrastructure at this level of funding. In response, Hatch voted to increase total federal funding in the multi-year transportation bill by $11.2 billion, which would raise Utah’s portion from the $269 million originally included in the bill to $282 million.
